Boardman man sentenced to
prison for sex abuse of children
Justin Jay Shelton, 29, of Boardman was sentenced
June 28 in Morrow County Circuit Court to serve 150
months prison on four courts of Sexual Abuse in the First
Degree. Shelton, a former Boardman Emergency Services
volunteer, was convicted by Judge Garry Reynolds on June
23,2005, after he found Shelton guilty of sexually abusing
two minor children aged six and three during the years
2002 - 2004.
Sexual Abuse in the First Degree is a Measure
Eleven offense. Each conviction carried a mandatory
minimum sentence of 75 months. Two of the convictions
were ordered to be run consecutive to get the 150 month
sentence. Under Measure Eleven’s truth in sentencing
provisions, Shelton will serve every day of the 150 months
sentence with no possibility of early release or good time
credit.

Elizabeth Ballard, was pleased with the sentence. “The
breach of trust and nature of the abuse in this case was
heartbreaking. We believed each victim deserved their own
justice. Judge Reynolds acknowledged each victim was
p recio u s and by running the 75 m onth sen ten ces
consecutively he sent a message to these young victims
that the defendant is being held accountable for the acts
that he committed against each of them. It is reassuring to
know that one of the victims will be over the age of 18
when this sex offender is released from prison and the other
will be just a couple of years shy.”
The case highlighted a recent dramatic shift in the
law surrounding the use of hearsay evidence in criminal
trials nationwide. David C. Allen, Morrow County District
Attorney said, “Because of the decision handed down by
the U nited S tates S uprem e C ourt in C raw fo rd v.
Washington, the state was not allowed to use the child’s
statements to others (hearsay) without the defendant having
an opportunity to confront her in court. In this case, the six
year old victim had to face her abuser in open court and
testify regarding her abuse. I am very proud of her bravery
and honesty. My office will continue to work with both
victims in our effort to ensure their continued safety.”
