Judge rules on
side of cattle
ranchers
Good news for the
Oregon
C attlem en’s
A ssociation (OCA) who
intervened on behalf o f cattle
ranchers who have grazing
permits on the Malheur
National Forest. Judge Jones
has essen tia lly ruled to
dism iss the US Forest
Service case on the Malheur
National Forest (Oregon
Natural Desert Association
vs. Malheur National
Forest). He asked the parties
to work out a stipulated
order, which is why this still
appears somewhat tentative.
However, he essentially
ruled from the bench in favor
o f the Forest Service and
ranchers.
The OCA had a
tremendous amount o f
support from the public in
helping to defend public land
gazing, including a recent
donation from Northwest
Farm Credit Services to the
Malheur National Forest
cases and a donation from
the Jordan Valley Rodeo
Association to the Southeast
Oregon
Resource
Management Plan. “As a
cooperative, we are keenly
interested in legislative,
regulatory and legal matters
im pacting our banking
operations, but more
importantly, those which
n egatively impact our
custom er-ow ners.
We
believe the Malheur Wild
and Scenic Rivers case has
that potential,” said Thomas
Tracy, E xecutive V ice
President and General
Counsel from Northwest
Farm Credit Services.
This decision is
critical to all public land
ranchers
in
Oregon.
Questions have been raised
in the federal court about
how the Forest Service
interprets fish monitoring
data and how they measure
grazing utilization described
in their forest management
plans.
Oregon
Natural
Desert Association (ONDA)
filed briefs stating the
Malheur National Forest
allotments are overgrazed
and fish habitat has been
degraded. ONDA claims
livestock grazing is causing
areas o f the allotments to
change from forest to desert
through the continued
grazing o f plants and soil
com paction from cattle
hooves. There are claims
that stream banks are
sloughing and sedimentation
is occurring everywhere
livestock have access for
crossing or watering. ONDA
weaves a story about Forest
Service making management
decisions with little regard
for the fragile environment
and endangered fish.
Cattlemen
have
heard these accusations
often enough and now the
courts are listening with the
Murderers Creek and
Malheur River permittees
caught in the m iddle.
ONDA’s claims have been
countered by photos and
hundreds o f sam ples
submitted on behalf o f the
grazers, which documents
the facts about grazing
riparian pastures w hile
sustaining a balanced
environment. The permittees
are managing the livestock in
ways
that
prom otes
vegetation vigor and
protects the stream and fish.
The Oregon Cattlem en’s
Association has intervened
with a very strong defense
against the outrageous
claims.
The final opinion will
have
significan t
repercussions for all public
land ranchers who have
federal grazing permits.
ONDA’s intent is to end
public
land
grazing
throughout Oregon using
similar accusations across
the landscape and agencies.
ONDA has filed a similar
case in the Freemont
National Forest and has done
an extensive request for
information on the Wallowa
Whitman National Forest.
The resolution o f the
Malheur River N ational
Forest cases will have a huge
impact on ONDA’s success
in the other cases.
Livestock producers
must defend their livelihood in
counties that benefit from
livestock grazing on public
lands and they must consider
the seriousness o f future
litigation that could take place
within their borders. The
Oregon Cattlemen are
compiling information for
Forest Service and BLM
permittees that may be useful
in documenting practices used
during the 2005 grazing
season.
