The real property is more com­
monly known as 113 Boardman
Avenue, Boardman, Oregon.
Both the beneficiary and the
trustee have elected to sell the real
property fo satisfy the obligations
secured by the trust deed and a
notice o f default has been re­
corded pursuant to Oregon Re­
vised Statutes 86.735(3); the de­
fault for which the foreclosure is
made is grantor’s failure to pay
when due the following sums:

owning on the obligation secured
by the trust deed immediately due
and payable, the sums being the
following, to-wit:
$39,915.49; plus interest
thereon at the rate of 13.0% from
September 1,1997 until paid; plus
late charges of $70.32 through
January 22,1998; plus $23.41 for
every month thereafter the regu­
lar monthly payment is more than
15 days late; plus unpaid real
property taxes; plus any reserve
account shortage; less any unap­
plied funds; plus all sums ex­
pended by beneficiary to protect
its interest during the pendency
of this proceeding.
WHEREFORE, notice hereby
is given that the undersigned
trustee will on Ju n e2 ,1998, at the
hour o f 10:30 a.m., in accord with
the standard of time established
by ORS 187.110 at the front en­
trance o f the Morrow County
Courthouse, 100 Court Street, in
the City of Heppner, County of
Morrow, State of Oregon, sell at
public auction to the highest bid­
der for cash the interest in the
above described real property
which the grantor had or had
power to convey at the time of
execution by grantor of the trust
deed, together with any interest
which the grantor or grantor’s
successors-in-interest acquired
after the execution of the trust
deed, to satisfy the foregoing ob­
ligations thereby secured and the
costs and expenses of sale, includ­
ing a reasonable charge by the
trustee. Notice is further given
that any person named in ORS
86.753 has the right, at any time
prior to five days before the date
last set for the sale, to have this
foreclosure proceeding dismissed
and the trust deed reinstated by
payment to the beneficiary of the
entire amount then due (other
than such portion of the principal
as would not then be due had no
default occurred) and by curing
any other default complained of
herein that is capable o f being
cured by tendering the perfor­
mance required under the obliga­
tion or trust deed, and in addition
to paying the above sums or ten­
dering the performance necessary
to cure the default, by paying all
costs and expenses actually in­
curred in enforcing the obligation
and trust deed, together with
trustee’s and attorney’s fees not
exceeding the amounts provided
by ORS 86.753.
In construing this notice, the
singular includes the plural, the
word “grantor” includes any suc-
cessor-in-interest to the grantor as
well as any other person owing
an obligation, the performance of
which is secured by the trust deed,
and the words “trustee” and “ben­
eficiary" include their respective
successors-in-interest, if any.

WHEREAS, Title VIII of the
federal Fair Housing Amend­
ments Act of 1988 as amended
prohibits discrimination in the
sale, rental, lease, advertising of
sale, rental or lease, financing of
housing or land to be used for
construction of housing, or in the
provision of brokerage, rental ser­
vices because of race, color, reli­
gion, sex, disability (physical or
mental), familial status (children)
or national origin; and
WHEREAS, it is the policy of
Morrow County to support the
Fair Housing Amendments Act of
1988 and to implement a Fair
Housing Program to ensure equal
opportunity in housing for all per­
sons regardless of race, religion,
sex, disability, familial status or
national origin; and
WHEREAS, the Fair Housing
Program, for the purpose of in­
forming those affected of their
respective responsibilities and
rights concerning Fair Housing
law and complaint procedures,
will at a minimum include, but
not be limited to: 1) the printing,
publicizing and distribution of
this Resolution; and 2) the distri­
bution o f posters, flyers, pam­
phlets and other applicable Fair
Housing information provided by
