The class action settlement is now pending in the Circuit Court of the State of
Oregon. Marion County. You may be a member of this class and thus eligible for monetary
relief as part of the pending settlement, but only if you were insured by SAIF at any time
between July l. 1981 and September 2, 1982.
The class action was brought by employers insured by the SAIF who claim, among
other things, that they were damaged by the State Legislature’s transfer of $ 8 1 million from
the Industrial Accident Fund to the State’s General Fund in 1983.
If you are found by the Court to be a member of the class, you are eligible to be
considered for relief provided under a proposed settlement agreement amounting to $225
million. Not all members of the class will receive monetary relief.
If the Settlement Agreement is approved, the Court will order that the Class be a
mandatory class and that you will not have the right to ask to be excluded from it or to
pursue your own litigation.
A hearing by the Court to
approve the settlement has been
scheduled for February 26. 1996 in
the Marion County Circuit Court,
Salem, Oregon.
If you choose to appear at
the hearing, you may be repre
sented by the plaintiffs’ attorneys
at no expense, or you may employ
and be represented by your own
attorney at your own expense.
