The Bureau of l.and Management
is accepting temporary permit ap­
plications
for
unauthorized
agricultural use of public land in the
Vale District Permit* will be issued
noncompetitively under Section .302
of the Federal taind Policy and
Management Act of 1976 (43
U S C 1732) for the same or similar
use ol the public land in trespass.
The issuance of the permit will pro-
v ide an opportunity for the users of
the public land and ihc Bureau to
resolve the unauthorized use in a
manner that is fair and equitable
Significant changes in use and/or
long term leases will be considered
on a case by-case basis under Sec­
tion 202 of the Federal land Policy
and Management Act
The purpose of the temporary
authorization program is to abate ex­
isting and prevent future unauthoriz
ed uses of public land on the Vale
District in Oregon and Washington
in a non punitive and cost effective
manner In order to participate in
B l.M ’s agricultural trespass resolu­
tion efforts, a trespasser who applies
for a temporary use permit must
show that His/her use occurred priot
to January I. 1987 and that he/she
acknowledges Federal ownership of
the land Permit applications must he
submitted prior to December 31,
1987 Unauthorized uses discovered
subsequent to (hat date may he sub­
ject to immediate eviction and
reclamation requirements, in addi
non to damages and full cost
recovery. Maps showing the public
lands open to permit and an mven
lory of known agricultural trespasses
is available at the Vale District Of­
fice and the Baker Resource Ares
Office
Permit applications and additional
information are available from the
Vale District Office and the Baker
Resource Area Office There is no
application
fee.
However,
agricultural use of public land is sub­
ject to fair market rental, and the
reimbursement of costs, in accor­
dance with 43 C FR 2920 6.
For a period of 45 days from the
date of publication of this notice in
the F E D E R A L R EG ISTER , in
tercsted parties may submit com­
ments to the District Manager.
