District Attorney Doherty concerned about possible drug changes

psychosocial impairment in
cluding psychosis, interper
sonal conflicts and physically
aggressive behavior caused
by the drug.
They also tested for psycho
motor impairment including
impaired judgement, im
paired coordination, impaired
alertness, impaired percep
tion and the permanence of
these impairments with the
drug use.
The committee also tested
for health impairment inclu
ding tissue change, risk of
overdose, dependency, sever
ity of physical dependence,
psychological dependence and
ease in developing depend
dence both physically and
psychologically.
In essence, they considered
the drug only in its pure form
to see how easily it could
become addictive to a user
and what kind of physical and
mental problems the use of the
drug would cause.
The committee did not
consider if there is even a
known medical use for the
drug, whether a drug com
monly leads to suicide or the
fact that a drug in its purest
form may not be harmful until
it is adulterated on the street.
Down-scheduling will make a
drug more readily available
for street use.
Downward classification
will hinder law enforcement
and is a remarkable departure
from the federal standards,
Doherty said in his critique of
the Controlled Substances Act.
No medical value
Doherty said there is no
proven medical value of
heroin, LSD, peyote, mesca
line and opium but if those
drugs are re-classified from
Schedule I to III, they could be
in any pharmacy under the
proposed new state law.
Presently, Schedule I drugs
are not in pharmacies but
Schedule II and III drugs are
but they are under lock and
key.
He added that drug crimes
and the severity of the
penalites that go with them
are determined by the drug

Morrow and the Motion of the City of
Heppner, Notice is hereby given that a
hearing will be held to hear objection, If
there are any, to the vacation of the
following portion of Thompson Street:
The west 5 leet of Thompson Street
running along the east boundary of tax
lot 500. block 4, Heppner Heights Ad
dition to the City of Heppner. This va
cation is adiacent to the Pioneer Me
morial Hospital and will run from the
intersection of Pioneer drive and
Thompson Street approximately 320
feel south.
The hearing will be held at 5:30 p.m.,
November 15, 1979 at the Heppner City
Hall. Any person objecting to the above
vacation may send written objections to
the City Hall prior to the hearing.

TRANSFER APPLICATION NO 4301
The Water Resources Director ot
Oregon has received and filed an
application by John B. Correa for
approval, without loss of priority, of an
additional point of diversion under a
certain water right.
The affected weter right is a portion of
the right described by the certificate
recorded at page 4859. Volume 42, State
Record of Water Right Certificates, in
the name of John 8. Correa, and is for
the use on not to exceed 1.74 cubic feet
per second from Butter Creek, under a
priority date of 1177, for irrigation of a
certain 4.0 ac in SW'j. NWV., 22.0 ac In
NWVi SWA. 14 0 ac in SW'i SW4, Sec
14; 9 0ac in SW4 NE4, 34.0 ac in SE',
NE'i, JO 0 ac in NE'4 SE'4, ft 0.5 ac In
SEV4 SEV4. Sec 15, T IN, T 27E, WM.
The authorized point of diversion Is
located S 86 degrees 15' E, 3230 ft from
WM.
The applicant proposes to establish an
additional point of diversion at a point
located 2790 ft N & 500 ft W from the SE
Corner of Sec 15, being within the SE'i
NE'4 of Sec 15, T IN, R 27E. WM.
Pursuant to ORS 540.520(2), a hearing
is scheduled for 9 30 a.m. on Tuesday,
December 11, 1979, at the Morrow
County Courthouse, Heppner, Oregon.
Any objection to the proposed change
must be prepared in writing: one copy to
be served on the applicant at Rural
Route, Echo, OR 97826; and one copy
filed in the office of the Water Resources
Director, Salem, OR 97310, together with
a $10 filing fee, at least 10 days prior to
the date set tor hearing Rules for filing
objections will be furnished upon
request.

will be hurt by the down-scheduling
of the drugs.
Doherty also said it does not
make sense that it does not
matter how much of a drug a
person has. Whether it is one
LSD pill or thousands of pills it
must be treated the same in
law enforcement. That part of
the law will encourage dealing
drugs in large quantities. He
also said the new law does not
increase the penalty for re
peat offenders.
Doherty commented that
the Board of Pharmacy must
approve the Controlled Sub
stances Committee's findings
but they cannot make any
changes. The board can only
send it back to the committee
if the board feels the commit
tee if the board feels the
committee did not show any
evidence for its findings.
The Morrow County D.A. is
also upset about the short
amount of time the public had
to comment on the commit
tee's work.
"In light of the fact that it
takes some time to mobilize
public awareness, and since
152 separate drug's are in
volved, this deadline, (Oct. 31)
seems totally unreasonable,"
Doherty said in his letter to
Governor Atiyeh.
Doherty said the short
amount of time and lack of
public input is why "There are
so many damn bad laws. The
deck was stacked and I don't
like it.
"I have spent a lot of time
examining the problem but
because of the short notice, I
felt it was urgent," Doherty
said.
