Smallmon no shoo-in for judgeship
Cont. from page 1
Smallmon noted a state law
(ORS 51.220) which provides
that if the Legislature estab
lishes a new district court and
abolishes a justice court, the
justice would occupy the
district court position during
the balance of his term.
Smallmon, who is an attor
ney and has served as justice
of the peace in Hermiston the
past eight years, told the
committee he was qualified to
be the new district court
judge.
"A legislative aid for Rep.
Duff, Ralph Currin, did some
research and raised questions
about that statute's constitu
tionality, based on the require
ment of having the governor
make the appointment," said
Smallmon.
"But according to legisla
tive counsel it's been on the
books for many years and it's
never been challenged."
Thome said Smallmon is the
likeliest candidate to be ap
pointed to the position. But
under the proposed amend
ments whoever is appointed to
fill the judgeship must stand
for election in 1980, after
spending less than a year in
office.
