Notice is given hereby that
an application has been filed
in the office of the Water
Resources Director by O.W.
Cutsforth, Jr., aka Fritz
Cutsforth, for approval of a
change in point of appropria
tion from ground water,
pursuant to the provisions of
ORS 537.705.
The certificate recorded at
page 33764. Volume 25, State
Record of Water Right Certifi
cates, in the name of O.W.
Cutsforth, describes a right
for the use of not to exceed 0.47
cubic foot per second from a
certain ground water aquifer
for irrigation of a certain 13.9
ac in SW'4 NE', 1.1 ac in
SE'-i NW'4 & 3.6 ac in NW'4
SEW; and supplemental ir
rigation of 7.6 ac in SW'4
NE1 1, 0.2 ac in SE"4 NEW, 2.4
ac in NE'4 SEW, and 8.8 ac in
NW'4 SE'4 of Sec 1, T IS, R
26E, WM, with a date of
priority of April 29, 1957.
The certificate recorded at
page 33863 of said Volume 25,
in the name of O.W. Cutsforth,
Jr., describes a right for the
use of not to exceed 0.6 cfs
from a certain ground water
aquifer for irrigation of a
certain 0.2 ac in NE'4 SE'4,
14.3 ac in NW'4 SEW, 14.3 ac

diverted from a well located
1490 ft N & 2140 ft E from the
SW Corner of Sec 1, being
within the NEW SEW of Sec 1,

The applicant herein, owner
of the lands above described,
proposes to change the point of
appropriation therefrom,
without loss of priority, to a
well located 200 ft N & 600 ft E
from the SW Corner of NW'4
SE'4 of Sec 1, being within the
NW'4 SE'4 of Sec 1, T IS, R
26E. WM.
All persons interested are
notified hereby that a hearing
will be held at the county
courthouse at Heppner, Ore
gon on February 8, 1979, at
9:30 a.m. All objections to the
proposed change, if any there
are. will be heard at said time
and place. Any and all
objections shall be prepared in
writing: One copy to be served
on O.W. Cutsforth. Jr., Rt. 2,
Heppner. OR 97836: and one
copy filed with the Water
Resources Dept., Salem, OR
97310. together with a $10 filing
fee. at least 10 days prior to
the date set for hearing. IF NO
OBJECTIONS ARE FILED.
