ORDER
IN THE MATTER OF
CALLING A SPECIAL
ELECTION ON THE
QUESTION OF APPROVING
A TAX LEVY OUTSIDE THE
CONSTITUTIONAL 6 PER
CENT LIMITATION.
THIS MATTER coming on
before the Morrow County
Court this 17th day of MAY,
1978, and
WHEREAS the Morrow
County Budget Committee has
met on three occasions to
consider the county budget
needs for fiscal year 1978-79
and has approved a budget in
the sum of $2,926,842.00, of
which $43fi,737.00 exceeds the
tax limitation provided in
Section 11, Article XI, Oregon
Constitution, and
WHEREAS it appears ne
cessary, in the estimation of
this County Court, to increase
the amount of the tax levy
over the amount limited by the
Constitution in order to' pro
vide funds to finance the costs
of county government and to
balance the 1978-79 budget,
and
' WHEREAS, it appears that
the County Court has author
ity under ORs 310.300 to call a
special election on the ques
tion of approving a tax levy
outside the tax limitation set
forth in Section 11, Article XI,
Oregon Constitution,
NOW, THEREFORE, IT IS
ORDERED AS FOLLOWS:
1. A special election shall be
held on the 27th day of June,
1978, for the purpose of
submitting to the qualified
voters of Morrow County, by
ballot, the question, to-wit:
Shall Morrow County be
authorized to levy and col
lect taxes in the sum of
$436,737.00 outside the limi
tation imposed by Section
11, Article XI, Oregon Con
stitution, for the fiscal year
commencing July 1, 1978,
and ending June 30, 1979,
these said funds to be used
to balance the county's
1978-79 operating budget.
2. The explanation of the
election question, to be printed
on the ballot in addition to the
ballot title, is as follows: The
County's 1978-79 operating
budget has been approved at
$2,926,842.00. The resources to
balance this budget come
from many sources, including
the local property tax levy.
The county's tax base for
1978-79 is $327,509.00. To bal
ance the budget, voter appro
val of an additional $436,737.00
is necessary. If this measure
is approved, the operating
budget to be financed by local
taxes for the 1978-79 tax year
vill be $509,061. 00 greater than
the operating budget financed
by local taxes for the preced
ing year.
3. The County Clerk for
Morrow County shall be the
Election Officer and shall
have the duty, power and
authority to administer this
special election as provided by
law.
4. The County Court has
previously designated THE
HEPPNER GAZETTE
TIMES as the newspaper
published and circulated in
Morrow County and in which
ballot facsimiles and election
notices shall be published, and
the County Court does hereby
ratify and affirm this designa
tion for the purposes of this
election.
5. A copy of this Order shall
be certified by the Court's
secretary and delivered to the
County Clerk.
