We leased some federal land
in a bird refuge for a fixed term.
The taxes assessed there under
ORS 3u7.ix0 were not paid and
the lease term has expired. Are
we still liable (or these taxes?
ANSWER:
The Supreme Court ruled
that: "ORS 307.060 does not
directly impose a tax upon the
(ederal government, the tax is
upon the lessee In event that
the tax is not paid the leasehold
only is subject to (oreclosure:
the hen does not affect the
interest of the federal govern
ment fee." Since there is no
property which would be in
cludable in a foreclosure pro
ceeding, ORS 311.650 makes the
tax in these circumstances a
debt due and owing from you.
