TAX FACTS
QUESTION:
My house is situated on a
hill and in February of 1972
the yard began slipping and
a portion of the lot dropped
three feet. Although cracks
are appearing in the base
ment area we have not vaca
ted the house. We applied
for a reduction in the value
of our house under ORS 308.
425. The assessor denied our
application on the basis that
the residence was not des
troyed. Was he correct in do
ing this?
ANSWER:
The assessor was correct
because "destruction" clear
ly means making the prop
erty no longer suitable for
residential purposes. The as
sessor will probably revalue
your house as of January 1,
1973, because of the slippage
which has affected the mar
ket value of the property.
