ORDER
There coming on for hearing
on October 6, 1971, the petition
of landowners requesting the
formation of a water control dis
trict under the authority of Ch.
553, ORS, and it now appearing
to the County Court that a pet
ition for the formation of such
water control district was filed
on August 25, 1971, with the
County Clerk of Morrow Coun
ty, State of Oregon, and that
such petition was in proper
form, was duly certified, and
was accompanied by a good and
sufficient undertaking, which
undertaking on said day was
approved by the Court; and it
further appearing that on said
September 1. 1971, the Court
herein made Its order fixing a
time and place for a first hear
ing on said petition, and direct
ed the County Clerk of Morrow
County, Oregon, to give notice
of such hearing by publication
as required by law, and it fur
ther appearing that such notice
duly was given and published
in the form and for the time
required by law, and proof of
such notice and publication
thereof herein has been made
and filed; and it further ap
pearing that at the time and
place fixed for such first hear
ing, no persons appeared to ob
ject to the formation of such
district or the proposed bound
aiies thereof; and It further ap
pearing to the County Court
that all lands included within
the boundaries of the proposed
district are and will be bene
fited by tho creation of such
district and the construction, op
eration and maintenance of
drainage, flood water control
.nd Irrigation works by such
district, and which will prevent
damage to end destruction of
life, and property by floods, and
will Improve the lands for ag
ricultural purposes, and will
improve the general health,
welfare and safety of the resi
dents of said district and the
public at large; and the Coun
ty Court now being advised ful
ly in the premises;

a final hearing upon the petit
ion for the formation of the
Heppner Water Control District
on the 24th day of November,
1971, at the hour of 10:00 o'
