Curfew for Minors.
RESOLUTION
THIS MATTER coming on be
fore the County Court sitting reg
ularlv for County business on
this 6th day of November, 1963,
and it appearing to the County
Court for Morrow County that
the said County Court now has
the power to create by ordinance
a curfew for minors pursuant to
House Bill 1307 approved by the
Governor of the State of Oregon
on the 21st day of May, 19G3,
and filed in the office of th?
Secretary of State and becoming
effective as a law of the State
of Oregon on the 3rd day of
September, 1963; and the County
Court further finding that it is
in the public interest for the
preservation of the health, safety
and morals of the citizens of
Morrow County that an ord
inance regulating the hours for
minor children to be out and
upon the public ways and streets
of the County; and the County
Court further finding that the
adjoining counties in Oregon, to
wit, Umatilla County, is now set
ting forth a similar ordinance
corresponding in time and in age
groups, and that the Counties
of the State of Washington, to
wit, the Counties of Walla Walla.
Franklin, and Benton, are also
creating ordinances for curfew
in the same manner and at the
same time in conformity with
Morrow County;
NOW. THEREFORE, IT IS
HEREBY ORDERED that the
County of Morrow does, by this
order regulate the curfew hours
of the County of Morrow in the
following manner and in the fol
lowing way:
ORDINANCE
I.
Curfew For Minors Regulations
A.
Definitions. The term "street"
shall mean any alloy, thor
oughfare, pathway, sidewalk
or other place of travel open
to the public.
B.
The term "highway" shall In
clude any road, lane or other
terminal or continuance of any
roadway, open to the public.
C.
The term "public place" shall
include, but not limited to,
places of amusement and en
tertainment, public building,
parks, playgrounds, dance
halls, vacant lots or other un
supervised places.
D.
The term "parent or guardian"
shall mean the actual parent
or legal guardian that has the
care, custody or control of such
minor.
E.
The hours of time specified In
this chapter shall refer to the
standard time prevailing in
the County of Morrow from
period to period, whether it
be what is commonly accepted
as Pacific Standard Time or
Pacific Daylight Time.
F.
The masculine gender as used
in this chapter shall include
the feminine gender, and the
singular shall include the
plural.
II.
Hours Places Exceptions, it
shall be unlawful for persons
under the age of 18 to be upon
any street, highway, park,
alley, or other public place,
between twelve o'clock a.m.
(12:00 A.M.) and five o'clock
a.m. (5:00 A.M.) on Friday
and Saturday nights, and be
tween eleven o'clock p.m.
(11:00 P.M.) and five o'clock
a.m. (5:00 A.M.) on any other
night, except when accompan
ied by his or her parent or
legal guardian, or in proceed
ing directly to or from his
work in the regular course of
employment, where such em
ployment has been approved
by competent authorities un
der the procedure outlined by
statute. If questioned by a law
enforcement officer, the bur
den of proving the right to be
upon any street, highway,
park, alley or other public
place, during the times above
specified, shall be upon the
minor.
It is FURTHER ORDERED that
the curfew hours and regula
tions shall become effective as
of midnight November 1, 1963:
and
It is FURTHER ORDERED that
the Clerk of Morrow County
cause the said Ordinance, as set
out above, to be published once
a week for two consecutive weeks
in a newspaper of general circu
lation within the County.
