that a special election has been
called to be held in the City of
Heppner on Tuesday, The 10th
day of February, 1959. The poll
ing place for said election will
be at the Council Chambers, in
said city and the polls will be
open from 8 o'clock A M until
5 o'clock P M. Said election has
been called for the purpose of
submitting to the legal voters
a charter amendment authoriz
ing $160,000.00 water bonds to
replace pipe lines as provided in
the following resolution:

mission to the legal voters of

jection at a special election to
be held as In this Resolution

CHARTER AMENDMENT SUB-
MITTED TO THE VOTERS BY
THE COUNCIL
An Act
To amend the Charter of the
City of Heppner, Oregon, by add
ing thereto Article authoriz
ing renewal, repair and improve
ment of the water system; and
the Issuance of bonds in the sum
of One Hundred Sixty Thousand
Dollars ($160,000.00) to provide
funds therefor.
BE IT ENACTED BY THE PEO
PLE OF THE CITY OF HEPPNER,
OREGON that the Charter of
said City be amended by adding
thereto Article to read as fol
lows: Article ..
(a) In order to provide funds
with which to replace water
Dipe lines, and repair and im
prove the water system of the
City, the Council is authorized
to issue and sell water bonds
of the City, in the sum of One
Hundred Sixty Thousand Dol
lars ($160,000.00). The said
bonds shall be in such form
and shall bear such Issue and
maturity dates as the Council
shall determine, but all of said
bonds shall mature within
twenty-five (25) years from is
sue date. Should the Council
so elect, it may issue the said
bonds with the privilege re
served therein, of redeeming
part or all of the bonds at
par value and accrued Interest,
upon optional dates to be de
signated in the bonds. The said
bonds shall be sold for not less
than ninety-eight (98) percent
of the par value thereof and
the full amount accrued Inter
est thereon.
(b) The debt limitations con
tained in the charter shall not
apply to any of the bonds here
by authorized.
(c) The Council hereby is auth
orized to fix and collect just
and equitable rates and charg
es for the use of the services
and facilities of the water
system; and to pledge all or
any part of the net revenues
thereof, to the payment of the
interest on, and to the retire
ment of the principal of, the
bonds hereinabove authorized
(d) So long as any of said
bonds or any that may be
issued to refund them shall be
outstanding, the Council shall
include in the annual tax levy
of the City a sum sufficient
with the aforesaid net revenues
of the said water system and
facilities, to pay the Interest
upon and the principal of the
said bonds as the said obliga
tions respectively become due
and payable. The said tax shall
be levied upon an ad valorem
basis upon all of the property
within said City so taxable for
its purposes.
RESOLVED FURTHER, that the
following ballot title is adopted
for said amendment:

City of Heppner once each week
for two successive weeks, the
first publication thereof to be
more than fifteen (15) days prior
to the election. The Recorder
shall also post notices of elec
tion in at least six (6) public
and conspicuous places in the
City at least ten (10) days prior
to said election, which posted
notice shall state the time, place
and purposes of the election but
need not contain the full amend
ment. RESOLVED FURTHER, that the
10th day of February, 1959, be
