This summons is served upon you
pursuant to an order of the Honor
able Claude McColloch, Judge of
the above entitled Court, made and
entered in the above entitled action
on the 9th day of February, 1942,
which said order provides for ser
vice of summons herein upon you by
publication thereof for four suc
cessive Weeks in the Heppner Gaz
ette Times, a newspaper of general
circulation in Morrow County, Ore
gon, published at Heppner, Morrow
County, Oregon, and designated by
the above entitled Court as the
newspaper most likely to give notice
of the pendency of this proceeding;
and which order further provides
that you and each of you shall have
a period of four weeks from the
date of the first publication of this
summons in which to appear and
answer the amended petition of the
petitioner United States of America
herein.
The date of the first publication
of this summons is the 12th day of

lived in one part, Mr. Berry, his
wife and boy in the other. All were
taken sick in one year. He lost the
father and mother first. Then Mrs.
Berry was taken with a throat trou
ble from which she succumbed. In
this last illness, Mr. Berry obtained
a specialist from Cincinnati to take
care of her at $100 a trip (this was
at the time of Cleveland's panic).
About the time the wife died, he lost
the home.
He stepped off the engine one eve
ning when he got in and started
hoboing, coming first to San Fran
cisco, then to Portland and on to
here.
He had a good run on the rail
road as testified by the fact that he
hauled McKinley through the cam
paign. He was chairman of the
grievance committee of his division,
and member of the board of exam
iners for young engineers on that
road.
Mr. Campbell testified that Mr.
Berry was an excellent steam engi
neer and "a faithful servant if there
ever was one." Mr. Campbell and
his son, Roy, called on Mr. Berry
at the hospital in Pendleton after
the affliction, and he was impressed
by the tremendous effort Mr. Berry
made to talk to them without avail.
M. L. Case returned home Friday
from a visit in Portland and other
points in the Willamette valley, Mrs.
Case remaining below for benefit of
her health.

lips of Burns were business callers
in the city Saturday evening. Mr.
Klemme is former district grazier
with Taylor Grazing act, now in
charge of state land board lands, and
Mr. Phillips is an attorney in the
Harney county seat.
. Mrs. P. A. Anderson was taken to
Arlington yesterday evening by her
sister, Mrs. W. C. McCarty, to take
the train on her way home to Seat
tle after attending funeral rites last
week end for her father, .the late
Eugene F. Campbell.
Mr. and Mrs. F. S. Parker receiv
ed a telephone call last evening an
nouncing the birth of a daughter to
their son and daughter-in-law, Mr.
and Mrs. John Parker, at Portland.
Named Mary Anne, the new grand
daughter weighed 7 pounds, 12
ounces. This is the second child of
the John Parkers, the son to cele
brate his second birthday on St.
Valentine's day.

FEED DEALER CALLS
E. C. Heidtbrink, with Sunset
Feed Mills, Portland, was in the
county yesterday looking for alfalfa
hay and barley. He believed that
by making a personal call at this
time he could make better contacts
for future delivery. This is a new
market outlet for Morrow county
hay and grains.
