BE IT REMEMBERED, That
County Court met in regular session
at the Court House in Heppner,
Oregon, on Wednesday the 3rd day
of December, 1939, this being the
regular time for holding a term of
said Court, when were present: Bert
Johnson, County Judge; George N.
Peck, Commissioner; L. D. Neill,
Commissioner; C. W. Barlow, Clerk;
C. J. D. Bauman, Sheriff; Frank C.
Alfred, District Attorney.
The minutes of the November,
1939 term were read and approved.
In the Matter of Claims:
Now, at this time, the various
claims against the County were pre
sented and the Court approved, dis
approved or continued them and
ordered approved claims paid by the
proper warrants from the proper
funds.
In the Matter of the Sale of Proper
ty of Arthur Ileid c-o Martin Reid
Seized for Delinquent taxes.
Court approves the sale of the
personal property of Arthur Reid
c-o Martin Reid for Delinquent tax
es for the years 1930 and prior to
and including the year 1940 am
ounting to the sum of $715.81, and
authorizes the Sheriff to satisfy the
assessment roll of all tax for which
said property was sold.
In the Matter of the Sale of County
Properties acquired at tax sale by
foreclosure.
Court orders Sheriff to advertise
and sell at public auction as re
quired by law the following county
properties:
Lot 5 in Block 1 Ayers Addi
tion to the City of Heppner,
Oregon, at a minimum price of
$40.00 cash.
Lots 3 and 4 in Block 8 of the
original town (now City) of
Heppner, Oregon at a minimum
price of $144.11, 20 pet. down,
balance on contract.
Northwest Quarter and South
Half of Section 7; North Half of
Northwest Quarter, Southeast
Quarter of Northwest Quarter
and Southwest Quarter of Sec
tion 18; Township 2 North,
Range 27 East of Willamette
Meridian, a total of 838.83 acres
at the minimum price of $838.83,

Court orders transfer of $5,000.00
from the Motor License Fund to the

agreement with Oris Padberg for
the sale of Lots 2, 3, 4 and 5 in Block
12 of the Original Town of Lexing
ton, for the sum of Three Hundred
Dollars, with Sixty Dollars down
payment, balance in 10 equal semi
annual installments with interest at
6 pet. per annum.
Court executes condition sales
agreement to Frank Young for the
sale of (SWV4) Section 30, NWy4,
West one half of the NEV4 of Section
31, all being in Township 2 South,
Range 23 East of Willamette Merid
ian for the sum of $500.00. $100.00
cash, balance in five equal annual
installments of $80.00 with interest
at 6 per cent per annum.
The Court executes condition sales
agreement with Florence Dalzell for
the sale of SEy4, EV2SWV4 of Sec
tion 31, in Township 2 South, Range
23 East of the Willamette Meridian,
for the sum of $300.00, $60.00 cash,
balance in 5 equal annual install
ments of $48.00 with interest at 6
per cent per annum.

Range 26, E. W. M. for the year 1940
for the sum of $10.00 cash.
In the Matter of the Delinquent
Taxes received for Special Road
Districts.
Now at this time, it appearing to
the Court that there are small am
ounts of Delinquent Taxes that have
heretofore been levied in Road Dis
tricts Nos. 1, 2 and 23, and, that have
not yet been paid to the Tax Col
lector, and
It also appearing to the Court that
said Road Districts having hereto
fore been abolished and the boun
daries thereof changed, so that the
territories heretofore included the
rein are now included in the Road
District comprising the entire coun
ty of Morrow, outside of the incor
porated cities and towns therein,
and that
Pursuant to Section 44-1501, Ore
gon Code 1935 Supplement, taxes
heretofore levied to be used in said
Road Districts and not yet expended
therein are required to be expended
in the locality or localities contem
plated at the time of levy, thereof,
and
That in addition to the small am
ounts of unpaid delinquent taxes
heretofore levied in said Road Dis
tricts there remains in. the hands
of the Treasurer of Morrow County
small sums of money collected on
the levy heretofore made for said
district, and that
Such small sums of money and
said unpaid delinquent tax money
when collected should be expended
within the boundaries of the re
spective district even though such
district no longer exists.
It is therefore ORDERED by the
County Court that the County Clerk
and County Treasurer be and they
are instructed to place all such funds
heretofore collected and which may
hereafter be collected pursuant to
the levy heretofore made for Dis
trict Road Tax in Road Districts
Nos. 1, 2 and 23 as they existed at
the time of said levy into the Gen
eral Road Fund of Morrow County
to be expended in the locality or
localities contemplated at the time
of levy.
