Thursday, August 4, 1939 School District Reorganization Law (Continued from last week) $ 35-5510 Method of voting The vote on the question of reject ing the state commission's order of adoption shall be by ballot, and the ballots shall have written or printed upon them For reorganization yes"; For reorganization no"; and the chairman of the meeting shall appoint two tellers who shall receive and count the ballots; provided, that in districts of the first class the judges shall be appointed in the manner now prescribed by law. The district clerk, or a person authorized by the board to act as such, shall keep a poll list and record thereon the name of each person voting upon such question at such meeting before such vote is received by the tellers. After all legally qualified school electors present have voted if they so desire, the chairman shall declare the vote closed, and the tellers or judges shall proceed to count the votes in the presence of the chair man. $ 35-5511 District clerk to send results of election to county boundary board The district clerk shall keep a tally sheet of the votes as counted by the tellers, which tally sheet shall be certified to as correct by the clerk, and signed by the chairman and tell ers. The tally sheet, poll list, and ballots shall be placed in a sealed package by the district clerk, who shall indorse thereon the number of the district, the name of the county in which it is situated, and the date on which said election is held. Such sealed package, together with a statement of the result of said elec tion, signed by the chairman and the district clerk, shall be forwarded by the district clerk within five days after said election to the district boundary board, directed to the county school superintendent as a member thereof. The district boun dary board shall, within ten days af ter the receipt of the sealed returns of such election, open the same and proceed to canvass the votes. 35-5512 Canvass of votes by district boundary board Noti fying districts or results Rear rantnnz and reorganizing re maining territory If the district boundary board shall determine from the returns that majority of all votes cast in the original school district voting is in favor of the reorganization, it shall immediately notify the district school board of the dstrict concerned of the result of the election and the order of the state commission shall be considered affirmed insofar as it pertains to the district. If the dis trict boundary board shall deter mine from the returns that a ma jority of all votes cast in the orig inal school district voting is against the reorganization, it shall imme diately notify the district school board of the district concerned of the result of the election and the order of the state commission so far as it pertains to the district voting shah . . . , . , j ' be considered as rejected and nuin fied. After such district boundary board shall have canvassed the votes on the proposition of reorganization the county school superintendent shall preserve in his office the bal lots, tally sheets, and poll lists in their original envelope for a period of one year. The state commission, through the local reorganization committee, shall assume jurisdiction in rearranging and reorganizing the territory remaining after the with drawal of an original school district or districts from a reorganized dis trict. $ 35-5513 Classification of school distncts All districts formed under the pro visions of this act shall be classified as districts of the first, second, or third class, according to the provis ions of section 35-902, Oregon Code 1935 Supplement, 35-5514 District school boards of first class districts If such reorganized school district, at the time of its reorganization, shall contain enough children of school aee. as shown bv the last school census, to be classed as a dis' trict of the first class, the district school board of said reorganized diS' trict shall consist of five (5) mem' Heppner bers, each of whom shall hold office for a term of three (3) years, to be chosen as follows: The directors of the most populous of the districts of which said newly reorganized dis trict was formed, as shown by the number of children of school age, according to the last school census, shall be the district school board of such newly reorganized district un til the first annual school meeting after the reorganization, when there shall be elected five (5) directors to hold office, two (2) for a term of three (3) years, two (2) for a term of two (2) years, one (1) for a term of one (1) year, the term of each to be determined by lot at the first regular board meeting after elec tion; provided, that the board mem bers of any district that was a dis trict of the first class prior to re organization and to which only parts of districts have been added shall continue in office to the end of their elected term of office. When but four districts have been reorganized into a single district which takes the classification of a first class dis trict, not more than two of the five board members may be elected from any one of the original districts in eluded in such reorganization, ex cept as otherwise provided in this act, and when more than four dis tricts enter such a reorganized dis trict, then not more than one of the five board members shall be elect' ed from any one of the original dis' tricts; provided, that in any election if no candidate is nominated from a district from which a board mem ber is entitled to be elected and if no person in such district receives one or more votes, the candidate, or candidates in cases where there is more than pne vacancy on the board of directors, coming from any other district, and receiving the greatest number of votes, who would not otherwise be elected or eligible to the office of school director in the district, shall be declared elected. 35-5515 District School boards of second and third class dis tricts If said reorganized district, at the time of reorganization, shall not con tain enough persons of school age, as shown by the last census, to be classed as a district of the first class, the district school board of said re oreanized district shall consist of three (3) members chosen as fol lows: The directors of the most pop ulous of the districts of which said reorganized district was formed, as shown by the number of children of school age, according to the last school census, shall be the district school board of said reorganized dis trict until the first annual schoo. meeting after reorganization, when there shall be elected in each such reorganized district three directors, who shall hold office one (1) for a term of three (3) years, one (1) for a term of two (2) years, and one (1) for a term of one (1) year, the term of each to be determined by lot at the first regular board meeting after the election; provided, that board members of a district, the boundaries of which are unchanged by reorgani zation, shall continue in office to the end of their, elected term of office When but two districts have been re organized into a single district which takes the classification of a second or third class district, not more than two board members may be elected from any one of the original districts included in such reorganization, ex cept as otherwise provided in this act, and when three or more dis tricts have been reorganized into single district which takes the class' ification of a second or third class district, not more than one board member may be elected from any one of the original districts included in such reorganization; provided, that in any election if no candidate is nominated from a district from which a board member is entitled to be elected and if no person in sue! district receives one or more votes, the candidate, or candidates in cases where there is more than one va cancy on the board of directors, re ceiving the greatest number of votes coming from any other district, who would not otherwise be elected or eligible to the office of school direct or in the district, shall be declared elected. Gazette Times, Heppner, 35-5516 Further of district boards and officers After the election of members of the board of directors as provided in this act, a director or directors shall be elected each year, and all vacan cies in the board shall be filled as provided by law. The terms of the school officers of all districts included in a reorganized district shall expire on the date of reorganization except those in the most populous district in the reor ganized district, whose term shall expire at the next annual school meeting except as otherwise pro vided in this act. 35-5517 General laws to apply to reorganized districts Trans portation All laws gverning regular school districts and officers shall apply to districts reorganized under the pro visions of this act; provided, that in any reorganized district taking the classification of the second or third class the board of directors in said district may provide transportation for pupils when it is deemed advis able by the said board without the necessity of being so authorized by the legal voters of the district as provided in section 35-919, Oregon Code 1935 Supplement. The district board may and upon petition of ten (10) legal voters or one-third (1-3) of the legal voters of said district shall call an election for the pur pose of voting upon the question of furnishing transportation as pro vided in section 35-919, Oregon Code 1935 Supplement. 35-5518 Determination of at tendance units The district school boards of re organized districts shall have power to define and determine attendance units within their districts irrespect ive of units recommended by the county reorganization committee or the state commission. 35-5519 Appropriation for county reorganization committee from county school fund For the purpose of carrying out the provisions of this act, there shall be appropriated by the district boun dary board from the county school fund for the expense of the county reorganization committee, an amount not to exceed three hundred dollars ($300) in each county affected by this act. (Chapter 468, Oregon Laws, 1939, H. B. 321.)
