There appears to be considerable misunderstanding in regard to the right of persons in the employ of the United States to vote in this state. Article 2, Section 4, of the Con stitution of Oregon reads as fol lows: "For the purpose of voting, no person shall be deemed to have gained, or lost a residence, by rea son of his presence, or absence while employed in the service of the Uni ted States, or of this state nor while engaged in the navigation of the waters of this state, or of the Uni ted States, or of the high seas; nor while a student of any seminary of learning; nor while kept at any almhouse, or other asylum, at pub lic expense; nor while confined in any public prison." Some persons have construed this section to absolutely bar members of the Civilian Conservation Corps from the right to vote, but the writer advised the county clerk that such was not necessarily true; but since the attorney general has ren dered a written opinion on the point at the request of Hon. George Codding, the writer was not free to write an opinion on the point How ever, the writer took the position that, if a person in the service of the United States had in good faith become an inhabitant of the State pf Oregon with the intention of es tablishing a permanent residence in this state, prior to May 4, 1936, and was a citizen of the United States and over the age of twenty one years, he had a right to vote at the ensuing election. The attorney general's opinion confirmed this opinion of the writer. If, however, the intention, in good faith, to be come a permanent resident of this state had not been formed prior to May 4, 1936, and accompanied by physically entering the state or be ing in the state at that time, then the person desiring to vote could not legally register or vote. The supreme court of this state held in the case of Wood vs. Fitz gerald that an employee of the Uni ted States may acquire a residence at the location of his employment by taking appropriate steps for es tablishing his domicile at such place. The question as to whether such person has taken appropriate steps to so establish his domicile, or legal residence, in good faith, is subject to inquiry. And if there is any reason to doubt that such per son has, in good faith, so established his domicile, it is the duty of the members of the election board, un der their oath, to subject the per son offering to vote to appropriate questions to determine whether in fact such person is qualified to vote. It has come to the attention of the writer that some persons have been contending that employees of the United States have the right to vote the national ticket even if they have not estbalished ' a bona fide residence in this state six months prior to the election. This is ab solutely erroneous. The right to vote is wholly determined by the state law. The only thing the gen eral government has ever done, which affects the right to vote is the enactment, of the 15th amend ment to the constitution, which pro vides that a state may not deny or abridge the right of citizens of the United States to vote on account of race, color, or previous condition of servitude. If a person has the right to vote for presidential elect ors, he has a right to vote for all other officers. If he does not have a right to participate in the election of state officersf. he has no right to vote for presidential electors. So, if any such person has reg istered, thinking he had a right to vote the so-called national ticket, the election board should not per mit him to vote. He should have applied to his own state election officials for an absent voter's bal lot No one can be qualified to vote in two different states; hence, any voter who is qualified to vote an absent voter' ballot In another state, is not quailed to vote in this State. Otherwise, the way to fraud ulent voting would be wide open. The writer believes, and has al ways believed, that every legal vot er should register and vote; but he is absolutely opposed to any illegal voting. The writer, under the old law, which provided that a voter could register by signing the neces sary application for registration be fore a notary public and two wit nesses, locked up his office and de voted six days to the work of reg istering voters in one campaign, and he urged members of the party opposed to his party to register, and actually registered dozens of the opposition party. lio person should swear falsely In order to vote. Irene Beamer, graduate of Heppner high school, was one of the 48 outstanding freshman women announced as pledges this week by the sororities of Pacific university in Forest Grove, where she is en tering her first year. Chosen by Kappa Delta sorority, Miss Beamer will remain a pledge for about a month and then will be formally in itiated into the organization.
