The Die is Cast
PONVENING of the second ses-
-'sion of the 74th congress this
week accompanied by President
Roosevelt's address on the state of
the union broadcast over a nation
wide radio hookup, closely followed
by supreme court's ruling the Ag
ricultural Adjustment act uncon
stitutional, this week focused pub
lie attention upon Washington. The
stage is rapidly being set for evolve
ment of major issues which will
play important roles in the fall
presidential election.
It is not improbable that soldiers
bonus, social security, stabilized
currency, balanced budget, and the
numerous other issues will be cast
into the background by a forced
test of constitutional government
itself. A defy was issued by the
president in his address to con
gress when he said, in effect, "the
congress can find ways of enforc
ing its own prerogatives and pow-
ers . . apparently in anticipa
tion of the high court's adverse
ruling on New Deal acts.
In former utterances the execu
tive threatened the high judiciary
if it dared not to accede to the will
of the legislative branch as dictat
ed by the executive. The threat
conveyed the possibility of enlarg
ing the judiciary department and
filling it with men who would bow
to the executive will.
The present crossing up of the
New Dealers by the supreme court
may or may not increase the tense-
n e s s between the constituted
branches of government, each of
which, is delegated separate and
distinct powers by the constitution.
If the president maintains a deter
mined course in accomplishing his
aims regardless of the judiciary
department, the issue will loom
large this fall.
That the supreme court was not
unmindful of the effect its decision
might have on the general public
welfare is shown by the fact that it
waited until congress had convened
before making the decision known.
Such action makes it possible for
congress to act immediately on
measures which may be needed to
bolster the economic structure
where it rested upon New Deal's
AAA.
It may be expected that congress
will act rapidly to provide neces
sary bolstering, for whatever the
future of AAA may be, nothing will
be left undone to preserve the gov
ernment's integrity. The $500,000,
000 still owing by the government
on unfulfilled contracts will un
doubtedly be appropriated and a
new source of taxation found to
supplant the processing taxes nulli
fied by the court's decision. Certain
it is there will be no delay in mak
ing the government's promise good
to those who fulfilled their part of
contracts with the government but
have not yet been paid.
There is nothing in the supreme
court's decision which attacks the
underlying principle of controlled
production, such as has been ap
plied to wheat growing in this sec
tion. The supreme court's action
merely takes issue with the right of
congress to usurp rights reserved
to the states and to the people by
the constitution. It denies the right
of congress to levy taxes for money
to be used in purchasing compli
ance. Such purchase interferes
with voluntary compliance and )s
contrary to constitutional safe
guard of the people'3 rights.
A question at issue is how far
congress may delegate extra-constitutional
powers unto itself in
legislating for the public welfare.
The supreme court has not taken
Issue with congress in that the pub
lic welfare was served by AAA. It
did point out that a dangerous
precedent had thus been set in that
should congress apply the same
principle to business and Industry
generally, all business and industry
would be subservient to the will of
the legislative branch of govern
ment There is need for cool, clear
headed thinking by citizens of the
United States Just now in determin
ing the future course of govern
ment. A crisis is present like unto
many previous crises from which
the constitution emerged unscathed.
Clear thinking will again uphold its
wisdom in providing a Btrong ju
diciary to assure fair and impartial
administration of government
They Lead.
WHEN the Oregon Woolgrowers
association meets at Baker this
week end, its sessions will be called
to order by J. G. aBrratt of this
city. He has served as the associa
tion's president for the last year.
At the recent convention of the
Eastern Oregon Wheat league In.
Pendleton, Harvey Miller of Lex-
ington was chosen as president of
that group.
Recently selected to head the
state high school athletic associa
tion was Edward F. Bloom, local
school superintendent
Mrs. Lucy E. Rodgers through
election to the vice-presidency of
Oregon State Teachers association
at its recent meeting in Portland
will serve as president of that body
next year.
Thus is Morrow county providing
leadership for large state and sec
tional organizations. So many
heads of so many organizations at
one time from a county of relative
ly small population is a distinction
of which to be proud. With such
leaders in our midst, Morrow coun
ty's light most assuredly will not
be hidden under a bushel.
WPA Cuts Road Cost.
A SAVING of 30 to 40 percent on
road construction work is being
made on four projects in Morrow
county through assistance of WPA.
Without WPA help the projects
probably could not have been un
dertaken at this time. WPA has
furnished fuel, oil, building mater
ials and hand labor to the amount
of the saving.
Compared with CWA and SERA,
WPA has been a great improve
ment The projects are better
planned, and the sentiment of the
sponsors seems to be that more
worthwhile work is being accoro
plished.
The feeling between the sponsors
and WPA is one of mutual helpful
ness and cooperation, and under
these conditions much good can be
done.

County Court met on December 4,
1935, when were present: Wm. T.

Minutes of the November term of
Court were read and approved. The
various claims were presented and eith
er appoved or disallowed. Those ap
proved were ordered paid from the
proper fund by proper warrant.
The Engineer's reports for the vaca
petition of C. D. Huston et al. for

road vacation were ordered continued.
The Court having received the amount
of State tax due and which should be
levied and being fully advised, made
the final adoption of the Budget as

General School $14,597.00.

and the furnishing of the required

posals and the awarding of the con
tract or contracts is conaitlonea upon
satisfactory assurance that the City of
Heppner will be able to secure from the
Federal Emergency Administration of
Public Works the aid necessary to
