SHIPPERS LOSE RATE CASE
U. S, Supreme Court Decides Against
Western Firms.
Washington, D. C. -Shippers charg
ed higher rates fot short hauls than
the published rates for longer hauls on
tho same railroad and In the same
direction can only recover such actual
damages as they can prove, the su
preme court held Monday.
In an opinion by Justice McRey-
nolds, It declared the fact that the
rate for tho longor haul was lower
than the rate for tho shorter haul
would not of itself establish which of
the two was tho unreasonable rate.
The question reached the court In
four cases. Three came from the Pa
cific const, being brought against the
Portland Seed company and A. J. Par-
rlngton, who won in the lower courts.
Tho fourth case came from Minnesota.
In all tho cases tho evldonce show
ed that the ruilroads had in effoct,
without the permission of the Inter
state commerce, commission, rates
which wero higher for a short than
tor a long haul. Tho shippers' es
sential chargo was "that (he carrier
demanded and received greater com
pensation for transporting freight for
a Bhorter distance than its published
rate fur transportating like property
for a longer distance over tho same
routo and In tho Bamo dlroctlon."
Tho shippers contended that under
the long and short haul clause the
ower publlshod rate became the maxi
mum which the carrier could charge,
notwithstanding the higher published
rato, and that any amount collected
abovo tho rate for tho long haul
amounted to an Illegal action, recov
erable without other proof of actual
dumago and without regard to the In
trinsic reasonableness of either rato.
Pointing out that the shippers had
not asked an injunction against Il
legal rates, tho court said that It was
"an efrort to secure something Itself
(themsolves) without proof of pecun
iary loss consequent upon the unlaw
ful act."
Congress has not given any indi
cation, tho court Bald, of an intent
"that persons not Injured might never
theless recover what would really be
a penalty, in addition to tho penalty
puynlilo to the government."

Radio Monopoly la Hit.
Washington, IV C A bill designed
to prevent a monopoly of radio com
munication was passed Mondsy by
he senate. It declares the air to be
the "inalienable possession ot the peo
ple" and prohibit licenses extending
more than two years.
Washington, D, C. A last 'minute
attack on the revenue bill In an all
day session of tho senate finance com
mittee Saturday brought changes In
the taxes on radio sets, jewelry and
estates, and postponed a report of the
measure to the senate until next
week.
The 10 per cent radio tax was made
applicable to all sets and parts with
out exemption after the committee
earlier in the day had voted to In
crease from ?15 to 50 the minimum
price of a set on which the tax would
be levied.
This and tho 10 per cent tax on
mah jongg sets costing more than
(5 aro the only new taxes carried
by the bill. The taxes are levied
on the manufacturer. The radio tux,
Chairman Smoot declared, would not
result in an increase in tho price of
the sets and parts to consumers.
Just which parts would be taxed,
however, would bo left to the Juris
diction of the Internal revenue bureau
as in the case of the tax on automobile
parts, Mr. Smoot said, lie figured
the tax would net about 110,000,000,
pointing out, however, that no ac
curate estlmutes were available.
Practlcully all of tho rato sched
ules now have been agreed upon, Mr.
Smoot said.
Chairman Smoot said the soldier
bonus bill passed by the house would
be tuken up by the committee. Little
time would be necessary for disposi
tion ot this measure, he added, and
several republican members predicted
the bonus bill would be given prece
dence over the tax bill on the floor
f the senate.
The house provision opening tax re
turns to Inspection by congressional
committees was broadened by elimin
ation of a previous restriction voted
by the finance committee, making it
possible for the committees to make
public "any relovant ot useful Inform
ation" obtained In Inspection of the
tax returns. The committee had pre
viously voted to allow congressional
committees to make public only the
names, addresses, amount of tux puid
and amount ot refunds given of the
taxpuycrs whose returns were Inspect
ed. Secretary Motion's proposal to cut
out the house amendment Increasing
the estate tux In favor of tho present
rules were agreed to definitely. The
committee had planned to keep the
present rates but apply them to dif
ferent brackets so that $12,000,000
additional revenue would be raised,
tho same as would have been gained
under tho house amendment.
It also was decided to limit articles
exempt from tho 5 per cent Jewelry
tux to thoso Belling for less than I'JO
ruther thun thoso selling for $10 or
less, as voted by tho houso. Musical
Instruments, eye glasses and spec
tacles, which were exempted by tho
house from any tax under this section,
sguln were mado subject to tho levy
and articles used in religious services
wero exempt entirely.
Changes made In the bill will not
alter materially the estimate that It
will full by about $50,000,000 of rais
ing sufficient revenue to meet eslimut
