An Ordinance granting jnto the Oregon Telephone and Telegraph Couiany, and ila assigns, the right and franchise to erect, maintain and operate, in the -City of Leba non, Linn Comity, Oregon, a system of cotes, wine and necessary appliance) for the transmission of electricity for telegraph vnd telephone nurposea. That there be and then ds hereby (tienand granted onto the Oregon Tele phone and Telegraph Company, and Its aaaigns,; the right and franchise to erect, aaaintain and operate, in the city af Leba Ben. Linn Connty, Oregon, a system of .pole, wires and necessary appliances for the transmission of electricity for telephone and telegraph purposes, in, along and upon (he following named street, and upon the conditions and requirements hereafter aet forth, to wit: Beginning at the Northern tetrninus of Main street; thence along Main Street to Rose street; thence West Along Rose atreet to Second street; thence South along Second street to its Southern fefminus thereof: And, also beginning t the Intersection of said Second and Grant streets, and running thence East to staid Main street, Thence along Main street iothe local office of said Company. &k. 2. That all such wires and conduct en ehsll he securely strong, not lets than iwenty-five feet shore ground upon round gotta not lew than twenty-five feet above ground and not less than four feet below .ground, and securely inbedded therein, and not less than eight inches in diameter at flic bottom and six inches in diameter at ttie top. Provided always, that all work clone, either in the construction or repair tilts system of poles and wires, shall be done under the supervision and by the direction of the street commissioner. Bsc. . Thatit shsllbe lawful for said Company or its assigns, to make all neo esanry eicavttions in and along the route, as herein before laid down, for Its system of poles and wires, for the purpose of tr eating and maintaining said system, -fisc 4. That, whenever said Company, r Us assigns, shsll disturb any of said ibftfs for tbe purpose aforesaid, it or they tkall restore the same to as good order and condition as when before so disturbed, as son si possible, and withont unnecessary delay. And failing so to do, shall be amenable to the Ordinances in such ssatdeand provided, and in addition there to, shall be liable to all damage occuring by reason of such failure. , 6ic. 6. That rothing in this Ordinance shall be so construed as to prevent, in any wise, the proper authorities of the said City of Lebanon, by its properly authorized offr cers or agents, from sewering, paving, grading, planking, repairing or altering any of said streets herein mentioned. Bac.fi, That, in consideration of the fight and franchise herein granted the City o Lebanon, by its properly authorised officers or agents, shall have the right to suspend upon the poles placed by said Company or its assigns, in the streets aforesaid, any or all wires which it may require for fire alarm or police or telegraph service. Sic. 7. That the right and franchise herein granted shall continue and be in force for the period of ten yeais, from the date of the approval of this Ordinance by the Mayor. Sac. 8. That work shall begin and rea sonable progress made upon the system herein described within two months and the same shall be completed and in opera tion within six mouths from the approval of this Ordinance by the Mayor. Sao. ft. That, within thirty days after die approval of this Ordinance by the Mayor, the said Company or its assigns, or authorised agent, Shall file with the Re corder of the City of Lebanon, a written ac ceptance of this Ordinance, together with all of its conditions and provisions. Fail ing so to do, this Ordinance shall be void and of no effect. Sac. 10. That this Ordinance shall be in full force and effect from and after its ap proval by the Mayor, and its written ac ceptance as provided in Section 9 of this Ordinance.
