All other sidewalks in said city. unlets otherwise provided by the council shall be fi feet 4 inches wide and shall be constructed as follows: Bearing! four Inches thick and four inches wide shall be laid on the ground or other suitable support at distance of 'Hi feet; there shall be laid on said bearings three tiers of stringers 9 inches Wrick and four Inches wide and 16 feet long of red or yellow llr; said stringers shall be placed eqnal distance apart, and well secured to the bearings by nailing them with 16-penuy nails. There shall be placed on said stringers decking inches thick of red or yellow fir plank W feet long not more than eight Inches wide nor less than tour inches wide, square edge and evenly sawed; all decking on alt sidewalks within said city to . be evenly and closely fitted together and firmly nailed to the stringers with Ift-penny nails; all to be done to a good warkmanllke manner, and the incline of no sidewalk shall be more than two inches' to each six feet running measure. SECTION 3. All crosswalks within the eity shall be constructed of red or yellow fir lumber. 8 inches thick by Sot M inches wide, evenly sawed and to be nailed on bearings or sleepers of red or yellow fir lumber nut leas than 4 inches by 6 inch es, and oval shaped aud there shall be at least4 of such bearings or sleepers under each section uf crosswalk; said crosswalk shall be from 3 feet toe feet wide on the level, that to to say on top, as the council may direct by order duly made and enter ed on Its Journal; theedgeto be leveled and a layer of gravel to be spread on each side of each ei walk and to extend the whole width thereof; the gravel to be raised to the level of the plank. It shall be the duty of the street commissioner, on or before the 1st day of June of each year, to obtain the names and make out in alphabetical order a complete list of all persons subjeet to poll and proiwrty lax for street and road purposes, and file the same with the Record er, and it shall be the duty of the Recorder, with in 28 days thereafter, to ascertain by awtement Use amount of poll and pnuierty tax, for mad and street nurpie, of all persons residing In or who have property within the city limits; and enter in a 1ook, denominated the iwwwnent book, fn alphabetical list of rhfc names of all persons aub- Jteet to poll or property tax, and' afttx thereto the amount of such poll or property tax, a provided in Sections 4 aud 5 of this Ordinance. SECTION 7. In assessing the real and personal property, for road and street purposes, the Re corder shall ascertain by diligent Inquiry the of all persons within the city lim.U, liable to taxation, and a list of all properly, real and personal, therein liable to taxation, aud appraise the same according to tlie laws of the state of Or egon; and he shall, as aweswr. require all perwns liable to be taxed to give uiniii oath a full and complete and correct description of all taxable property owned by him or her, wilhrn the city limits, or by him or her managed or controlled as agent or attorney, within the city limits. And, 11 any person refuse or neglect to make the oath herein required, the Recorder shall ascertain, from the best information to be had, the taxable propertyowned ormanagediireoutrolledbysuch i person. SECTION 9. Any violation hy any . contractor or contrwtors of any provision of this Sw'ttmi shall work a forfeiture of any contract so entered into and the said con tract may, at the option of the City Council be held and declared null and void. SECTION 13. It shall 1 the duty of the street commissioner, in ease no contract is mude as provided in Section 13 of this Onli nance, to employ men and tennis in suffi cient numbers, and, with them, work the hauls and streets within the corporate lim its of the city, always giving preference to residents of said eity. AH parties so em ployed, and all parties furnishing materials, at the mmest of the street commissioner, tor use on said streets, shall furnish to said commissioner a statement of tlte time cm ployed, tin materials furnished and the price charged for the same. This statement, if found correct, shall be endorsed hy the said commisMionur as correct, and the sold commissioner shall, with the consent of the City Council draw a warrant upon the Treas urer for the payment of the same, which said warrant shall he paid out of the mud and street fund in his hands. , HKCTION 14. If any street ioiiiiiiIk sioner shall neglect to perform the duties required for him hy this ordinance, or shall, under any pretense whatever, give or sign any receipt fur road and street tax, unless the money shall have already been paid; or shall pay out money; or endorse as cor rect; any account or draw any warrant uou the treasurer, for any wora done or materials furnished, upon and for the streets of the city, unless the said work has been done and tlie said materials nirmshed, as stated; or shall fail or refuse to pay over any and all money and moneys received hy him, as street Commissioner, to the City Treasurer, as required hy this tmuuauce, ne suuu, uinih eimviction there of before the City Recorder, lie lined not less than $10 nor more than $10u, or to im prisoned in the city jail not less than 5 days nor more than 60 days, for each offense. Complaint may be made hy any tax-payer ot tlie city before ilie City Recorder, for any violation of this ordinance. HECTION 15. The Street Commissioner shall receive for his seivicesthe following eoiiitiensatiou: Five icr cent, of nil mon eys colletted aud paid over to the City Treusurer hy him, as such Commissioner; and also for each day necessarily en gaged in suitervifling the working of the rouds und streets and in discharge of any other duty required of him by this ordi nance, the payment of which Is not other wise provided for. The said Commissioner shall, at the lirst regular ' meeting of the Council in Decem ber of each year, muke a full and complete report to them of the amount of money collected and puid over to the City Treas urer by him; tlie amounts puid out, to whom paid, for what purpose paid, to gether Kith a true and correct statement of the amount due him for the pmper ir furuianub of his duties, as by this ordinance provided. If said bill is found to to correct by the Council, the same shall to by them allowed and a warrant therefore be drawn tq on the City Treasurer, to to paid out of the mud and street funds iu his lmn!s. SECTION 10. All ordinances und putts of ordinances in conflict with this ordinan ce ure hereby repealed. HKCTION 17.
