WS-709C Sealed bids will be received by the City of Camas, Office of the Finance Department, 616 NE 4th Avenue, Camas, Washington, until 2:00pm on Thursday, February 19, 2015, and will then and there be publicly read for the construction of the improvement. All bid proposals shall be accompanied by a bid proposal deposit in cash, certified check, cashier’s check, or surety bond in an amount equal to five percent (5%) of the amount of such bid proposal. Should the successful bidder fail to enter into such contract and furnish satisfactory performance bond within the time stated in the contract documents, the bid proposal deposit shall be forfeited to the City of Camas. Statement of Work: This project consists of construction of a new drinking water treatment plant, including an Administration Building with office, shop, and process area; a Roughing Filter, Filter Gallery, Slow Sand Filters, and associated site improvements. Federal Funding: This project is financed through the State of Washington Public Works Board Drinking Water State Revolving Loan Fund with funds obtained from the U.S. Environmental Protection Agency and Washington Department of Health. The Contract is subject to regulations of the U.S. Environmental Protection Agency, Depart- ment of Labor and Industries, State of Washington Public Works Board, and Department of Health. All work performed on the project will be subject to the higher of the prevailing state or federal wage rates. Federal and State wage rate determinations are included in the bidding documents and shall be verified by each bidder prior to submitting a bid. Attention is called to Federal provisions for equal employment opportunity nondiscrimination laws, including Chapter 49.60 RCW and 42 U.S.C. 12101 et seq, the Americans with Disabilities Act (ADA), Environmental Protection Agency’s Program for Utilization of Small, Minority, and Women’s Business Enterprises. All work performed on the project will be subject to the higher of Federal Davis-Bacon Prevailing Wages or State Prevailing Wages on Public Works projects as set forth in the Contract Documents. The Contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this Contract. The Contractor shall carry out applicable requirements of 40 CFR Part 33 in the award and administration of contracts awarded under Environmental Protection Agency financial agreements. Failure by the Contractor to carry out these requirements is a material breach of this Contract which may result in termination of this Contract. This Contract shall be subject to the Equal Opportunity requirements set forth in 41 CFR Part 60-1.4(b). This Contract shall be subject to the requirements of Section 504 of the Rehabilitation Act of 1973. Prohibition Statement: The Contractor, its employees, sub-recipients under this award, and sub-recipient’s employees may not engage in severe forms of trafficking in persons during the period of time that this award is in effect; procure a commercial sex act during the period of time that the award is in effect; or use forced labor in the awards or sub-awards under the award. E-Verify Requirements: Per City of Camas Ordinance No. 2626, as a condition for the award or renewal of any contract after January 1, 2012, the Contractor shall enroll in the E-Verify program through the United States Depart- ment of Homeland Security and thereafter shall provide the City with a copy of the Memorandum of Understanding (issued by Homeland Security), submitted with their bid proposal, affirming their enrollment and participation in the program. The Contractor shall be required to continue their participation in the program throughout the course of their contract with the City. Prime contractors shall require and verify that each of their subcontractors and lower tiered subcontractors are also enrolled and participants in the E-Verify program. This is intended to be used exclusively for employees hired after award and for the duration of the contract with the City of Camas. E-Verify is an Internet based system operated by the Department of Homeland Security in partnership with the Social Security Administration at no charge. SAM.gov Requirements: A Contract cannot be awarded to a proposer where the Contractor, subcontractor, or vendors are on the Federal Exclusion List as found at SAM.gov. Bidders are advised that the status relative to the Federal Exclusion List of the prime contractor, subcontractors, and vendors will be verified prior to award. Whistleblower Protection: This Contract shall be subject to the laws set forth in the Whistleblower protection Act of 1989 for employees who work for the federal government. Whistleblowers may file a complaint that they believe reasonable evidences a violation of a law, rule, or regulation; gross mismanagement; gross waste of funds; an abuse of authority; or a substantial and specific danger to public health or safety. A federal agency violates the Whistleblower Protection Act if an agency or agency authorities take (or threaten to take) retaliatory personnel action against any employee or applicant because of disclosure of information by that employee or applicant.
