Constitutionality Of Act To Ee Passed Upon By The Courts. The mining Arms of this city are contributing to a fund being raised to test the constitutionality of the Eddy corporation tax law, passed at the last session of the legislature, And It is understood that the move- but of various and mei cant Up concerns. Attorney .1. Sohnubel, of (I'oitland, has been authorized to act for a number of corporations, both , local aud foreign, aud it is stated jthat a suit is to be tiled at once. A 'test case will be made iu the instance i of some individual corpotatiou as ' plaiutitr aud the secietaiy of state aud state treasurer as defendants. In a recently published interview regarding the matter, Mr. Schuubel said : "It is unconstitutional. It Is double taxation, and not uniform. It is called a license, but is revenue producing. "Tho secretary of state has de manded a report from all corporations doing business iu Oregon. That goes so far as to mean that if I write to Montgomery, Ward A Co., in Chicago, to send me a bill of goods they are liable for taes In this state. Auy outside corporation lining mail orders would be liable. If a corporation in another statu sends 11 traveling salesman hero to take orders, the corporation would have to pay a license I believe the secreatry of state holds that all corporations doing any business whatever iu this state are Included, but I understand he has asked Attorney General lllackhuru for an opiuou as to how far-reaching tho law is, aud if a corporation that has no branch here is liable. F DIVISION OF CLAIMS EFFECTED North And South Pols Com panies Reach Settlement Of Matter. It is understood that the matter of effecting a dlvlsou of the claims held iu common by the North aud South Pole companies has been practically concluded. Tho negotiations have been conducted by Hon. J. 11. Itobbins representing South Pole people and Kinil Meler tho North Pole. When approached regarding tho matter Mr. Itobbins stated that while uu amicable settlement has been reached botwen himself and Mr. Molzor, tho transaction has not boon rutitled by tho two companies and no pupors signed. For this reason bo declined to make public tho details until after tho papers buvo boeu signed. Tho claims involved In which the two compauies hold joint interests are: Tho Vlllard In which the North Polo ownod throe-fourths, South Polo, one-fourth; Yankeo Jim, half each; Yankeo Jack, ouo-half each. Tho importance of tho deal 1h at onco uppurout, slnco it throws these rich and valuable claims open to developmeent. The claims are on the mother lodo and adjoining the end lines of both compauies.
