A press dispatch from Holse snys: Judge Heatty, of the United Stateseourt, handed down a decision for the defense in the famous ease of 1 'at rick Clark et ill vs. Charles Sweeny et nl, Involving the ownership of the Klla claim, adjoining the Tiger-Poorman at Burke, in the Cieur d'Alenes. Sweeny purchased the Klla from plaintiffs for f-1000. It was claimed afterward that he secured it through misrepresentations and fraud, it being asserted that the property was then worth 1,000,000. Suit was brought for cancelation of the transfer. It has been a sensational pr- ceeding through out and has attracted a great deal of at tention. Referring to the charge that the Klla was clandestinely explored, the opinion says: "While there is no evi dence or authority for, or objection to what defendants may have done, it seems that since the time of Clark's manage ment workings have been extended into this ground without question and acqui esced in, and it may have been because the old company owned the ground on loth sides of the Klla. Sweeny says lie found the works there and used them without knowing of any objection. Un der such circumstances it can not be concluded that such possession was. clan destine or for the purpose of defrauding the Klla owners." Patrick Clark said to n Spokesman-Hevlew reporter, on learn ing of the adverso decision in his case against the Kmpire State-Idaho com cem pany: "Although we should have been more pleased to have won the decision, we are not nt all discouraged at having lost it. This is hut the opening round in this contest, and no matter who should have won, the case would have gone to the higher courts. We certain ly exicct to take it up before the court of upieals."
