Wednesday, July 3, 1.901 THE SUMPTER MINER M ORDINANCE NO. An ordinanco granting to the Sumpter and Bourne Railway Company, it suc cessors mid assign?, n franchise to lay railway tracks in the City of Sumpter, and to operate and run electric cars and electric trains thereon. Tiik Citv of SujiiTEii Does Ordain as Follows : Section 1. That a franchise for the period of JHty years from the date of the passage of this ordinance is hereby granted to the Sumpter and Bourne. Kail way Company, itssuccessora und as signs, to establish, locate, lav down and maintain railway tracks, with switches and sidings, from the northern boundary of the cortiorato limits of the City of Sumpter, South along Bourne avenue to Granite street, thence south along said Cracker street to tho line of the railway of tho Sumpter Valley Kail way Company, thence southeasterly ami parallel with said lino of railway of said Sumpter Valley Railway Company to Mill and Auburn streets. Also from Cracker and Granite streets along said Granite street to Mill street, thence south on Mill street to the south erly terminus thereof. Also from Austin and Mill streets cast along raid Austin street to the bound nry of the corfmrate limits of the said City of Sumpter. Also from Austin and Bonanza streets south on said Bonanza strvot to tho smelter plant erected by the Union Smelter Manufacturing Company, all in said City of Sumpter. Section 2. That a franchise for the period of fifty years from the date of the passage of this ordinance is here by granted to the Sumpter and Bourne Railway Company, its successors and nssigns to run and operate electric cars ami electric trains upon such railway tracks as may bo constructed by said Sumpter and Bourne Railway Com pany, its successors and assigns, under the franchises granted by thisordiiiance. Section 3. That a franchise for the period of lifty years from the date of the passage of this ordinance is hereby S ranted to thu Sumpter and Bourne tallwny Company, its successors and as signs, to excavate for, erect and main tain poles and wires, and such other de vices for the distribution of electric pou'or us it may deem oxcdient, in the manner which may now or 'hereafter be provided for by ordinance or ordinances of the City of Sumpter, along the routes of railway for the construction of which franchises are by this ordinance granted. Section 4. The tracks of said railway shall bo laid flush with tho grade of streets where tho streets are graded, and said Sumpter and Bourne Railway Company, its successors and assigns, shall plank, pave or mecadamise, and keep in constant repair, as tho munici pal authorities of the City of Sumpter shall direet, that portion of the street or streets along and over which said rail way or any switch or siding shall be laid at grade, the whole of said railway, switches and sidings between the tracks thereof, and for the width of eighteen inches on the outside of said rails, and for the width of the space between a main lino of railway and any switch or siding in connection therewith. Section 5. The franchises grouted by this ordinance uro granted only niton the understanding and condition that work upon the construction of a of railway by said Sumpter and Bourne Railway Company, its successors or.assigns, from the City of Sumpter, In thu Comity of Baker uud State of Ore gon, to the Town of Bourne, in said County and State, shall be actually com menced by Novemlier 1st, 1001, uud thereafter continuously prosecuted to the extent the weather permits, and that a line of railway from said City of Sumpter to said Town of Bourne, shall bo completed and in actual oiwratiou by November 1st. 1U02; anil the City of Sumpter hereby reserves tho right, in the event that actual work shall not be commenced upon suid proposed line of railway by said November 1st, 1001. and thereafter continuously prosecuted to tho extent the weather may permit, or in the ovont that said railway from said City of Sumpter to said Town of Bourne shall not be completed and in operation by November 1st, 1002, to de clare by ordinanco, all the rights, privi leges and franchises hereby grunted to said Sumpter and Bourne Railway Com pany, forfeited and determined ; and in the event that said line of railway shall not be completed from Sumpter to Bourne, by said 1st day of November, 1902, and the rights, privileges and fran chises granted by this ordinance shall be declared by the City of Sumpter, for feited and determined, all trackage laid and other improvements made by said Sumpter and Boumo Railwav Company, within the City of Sumpter, in connec tion with said line of railwav. shall bo and become tho property of 'the City of Sumpter. Section ft. Tho franchise granted by this ordinance for a lino of railway froiii Cracker and Granite streets, thence oast on said Granite street to Mill street, thence south on Mill street to Auburn street, is hereby declared to lie a fran chise granted for the purposes of passen ger tratllc only, and the City of Sumpter hereby reserves tho right, in addition to tho rights heretofore reserved in this ordinance, to declare, by ordinance, tho franchise along said streets last named, forfeited and determined, should said. Sumpter and Bourne Railway Company, its successors or assigns not complete and have in operation by November 1st, 1002, a line of railway along said streets for the carrying of passengers; and the said City of Sumpter also hereby re serves the right, should said Sumpter and Bourne Railway Company, its suc cessors or assigns, at any time after No vember 1st, 1002, fail for any live days in any one month, to oerato said passen ger line along said streets last named, or should fall to make at least two round trips per day thereover between tho City of Sumpter and the Town of Bourne, or should fail to make the number of trips thereover within the limits of the City of Sumpter, which the council of the City of Sumpter may declare to be necessary to accommodate tho passenger tralllc thereover, to declare, by ordinance, the franchises granted by this ordinance for said line of railway from Cracker and Granite streets west to Mill street, and thence south on said Mill street to Au burn street, forfeited and determined, in which ovont the trackage of said rail way company on said streets shall be come the property of tho City of Sump ter. Section 7. The franchise granted by tliis ordinance for a line of runway from the line of railway of the Sumpter Val ley Jtuilwuy Company's line of railway to Auburn and Mill streets, is granted subject to all present existing rights, privileges uud franchises now held, owned or possessed by said Sumpter Valley Railwuy Company. Section 8. All the franchises granted bv this ordinanco aro eranted uihiii tho condition that said Sumpter and Boumo Hallway Company, us successors or as signs, shall, after the completion of its proposed line of railway from Sumpter to Bourne, continuously operate the same, uud shall make at least two trips per day, unless prevented by the action of the elements, fire or other unavoid able casualty, between Sumpter and liourne, una siiouiu sum bumpier una Bourne Railway Company, its successors or assigns, after the completion of its railway from Sumpter to Bourne, not oorate the same us provided for in this ordinance, an ine ngnis, privileges ami franchises granted by this ordinance, may, by ordinanco, be declured forfeited and determined, and all trackage and other improvements mude by said Sump ter and Bourne Railway Company, with in the City of Sumpter, its successors or assigns, shall, in case of such declaration of forfeiture, lie uud become the proerty of the City of Sumpter. Section 0. The railwuy tracks from Austin and Mill streets along said Aus tin street to the corjioriitu limits of the City of Sumpter. and from Auburn mid Mill streots south on Mill street to tho southerly terminus thereof, and from Austin and Bonanza streets south on Bonanza street to the smelter plant erected by the. Union Smelter Manufac turing Company, franchises for which ure granted hy this ordinanco, shall be laid and curs uud trains otieruted there on, or on uny part of said streets last above named, within such time us the council of the City of Sumpter shull by ordinance hereafter fix, uud if suid rail wuy stracks shall not be luid und curs operated thereon within such time us the council may by ordinanco fix, the council may declare the franchise for a railway truck umjii such streets or or tiou thereof us the council muy have or dered a railwuy truck luid, foneited uud determined, provided that said Sumpter and Bourne Railway Comimuy, its suc cessors and assigns, shull not be required to lay trucks or operate cars or trains on uny of said streets lust named before November 1st, 1002, and provided, fur ther, that said Sumpter und Bourne Railway Comjiany, its successors or as signs, shull not ucquire any right to lay a railway truck or retain a franchise therefor, on uny ortion of the streets last above named, unless said railway track or tracks shall be completed to thu extent the council of the City of Sumpter may by ordinance order. Section 10. The said Sumpter and Bourne Kailway Company, its successors and ossigns, shall bo doomed to have for foitod nil rights, privileges and fran chises granted by this ordinance, unless it shall, or some one In Its behalf, tile with the Recorder of the City of Sump tor, within thirty days from tho date of the passage of this ordinance, a written acceptance of the provisions of thisor diiiance.
