EMOTIONAL JURIES
Our lAmcrican jury system is sup
posed to be based on human reason.
But it isn't. It's based on emotion.
Appeals to our juries are notoriously
emotional in matter and method.
I-awyers play with the jurymen's feel
ings aa nvusicians on an organ. The
result is that jury decisions usually
reprcsent sentiment rather than judg
ment, in cases where human passions
are involved. Often they rpresent
mere sentimentality, carried to atv
surd lengths.
The Mint. De Saulles case is an
other instance of the old, familiar
story. She killed her divorced hus
band. There was no question about
that, no denial. Theoretically, our
law regards killing one's divorced hus
band as a capital crime rather than a
misdemeanor or a playful trick. The
fact that the man in question may
have been a moral reprobate, and may
have aroused the righteous wrath of
the defendant by refusing to let her
have her son according to agreement,
is not regarded as justifiable ground
for killing him.
If the woman knew what she was
doing, she was guilty of murder. If
the did not know, she was crazy. The
theoretical penalty for murder is
Jianging. The theoretical treatment
for insanity ia confinement In ei
ther case the idea is to save soeiety
from further peril
The De Saulles jury must have con
cluded either that the defendant had
a right to kill her husband, or that
he was insane -when she did it Prob-

.),t for the student fellowship war
fund which exceeds the amount ap
portioned by SS93.
"All pledges are now due ami
should be paid at once," said James
Mhcpherson. general secretary of the
Y. M. C. A. "If anyone has been
missed in the canvass he can still
pledge toward the fund if he will pay
his pledge immediately. One fellow
who enlisted this week came in and
gave me $10 just before he left."
The official bulletin from the Ore
gon headquarters reports the amounts
given by the colleges of Oregon. The
bulletin begins:
"Are you proud of Oregon? You
ought to be. Some of the reports be
low are not final. Just like a bij
football game. You can't stop them.
When you know that $10 will save
the life of a soldier in a prison camp,
this winter, you don't want to stop
them, either."
