Section h . The council, sittin g as a c an v as sin g b o ard, is the ju d g e o f tin*
qu alific atio n s and election of th e mayor and the eouncilmeu, an d in case o f a
co n test between two or more persons claim in g to be elected ther eto, m u st d e t e r
m in e th e same, subject, however, to review by a n y c o u r t o f com petent jurisdiction.
Contes ts for nil other offices must be governed by t h e laws of the s t a t e regulating
proceed ings in contested elections for co u n ty offices, b u t in case two o r more
ca n d id a te s shall h ave an equal and the hig hes t n u m b e r of votes for a n y office
provided for in th is act, the common council shall decide th e election.
►Section !>. All persons elected or appointed to a n y office shall be legal
electors of the town and shall, before e n terin g upon th e d u ties th ereo f, t a k e an d
su b scrib e an o ath or a f f i r m a t i o n to su p p o rt th e C o n stitu tio n an d laws o f th e
U n ite d States, the Con stitution and laws of th e S t a t e o f Oregon, an d f a ith fu lly
t o per fo rm th e d u ties o f th e office to which he m a y h ave been elected or
ap p o in ted , to tin* bes t o f his knowledge an d ab ility , a n d comply w ith such other
p rere q u is ites as may be required b y ordinance.
Section 10. In case a n y vacancy shall occur in a n y elec tive office, th e same
shall be filled b y the common council by electing some qualifie d person to fill
such vacancy.
►Section 11. W henever the town shall h av e been devided into war ds, each
w ard shall elect one councilman in each y ear, unless in case of filling a vacan c y
a n d then th ey shall elect one for one y e a r and one f o r tw o years.
Section 12. All p resent officers of said town, e i t h e r elective or appointive,
shall serv e till the ex piration of th eir respec tive term s, or u n til th eir successors

ARTICLE V.
►Section 1. T h e common council shall hold th e i r f i r s t regular m eetin g on the
second d ay of April or within f i v e d a y s t h e r e a f te r , an d it shall o rganize and
f i x th e tim e and place for holding t h e regular m eetings for th e y ear. T hey
shall choose one o f th eir n u m ber to preside over the council and prefo rm th e
d u ties of mayor for such y e a r in the ab sence of th e m ay o r or d u rin g his in ab ility
t o act. He shall lx* d esignated a n d k n o w n as th e “ Chairm an o f th e Co uncil,”
an d for such y ear, d u r i n g all tim es when th e m ay o r is ab s en t or unab le to
a t t e n d or act in a n y m a tte r , such ch airm an shall h ave an d exercise t h e powers
a n d per form the d u ties of m ayor; an d if a t an y m eetin g both th e m ay o r an d
c h air m an are ab sent, th e eouneilinent p resen t shall elect one of th e ir num ber
c h air m an pro tom., who shall preside f o r th e purposes o f such meeting.
Section 2. The council shall p rovide rules for its g o v ern m en t an d for
i t s members, an d shall have power, by a th r e e -f if th s vote o f the councilmen, to
expel a n y mem ber o f th e council for d iso rd erly conduct in th e council ch am ber
or continu ed absence an d gross i n a t t e n t i o n to t h e d u tie s of councilmen. And
may declar e the o ffice o f a n y councilm an v acan t who shall be g u ilty of scan
dalou s conduct.
But no councilman shall bo expelled w ith o u t notice a n d
o p p o r t u n it y o f a h earin g b y th e council. A change o f residence by a council
m a n to a n y place outside the co rpora te limits o r to a d i f f e r e n t ward, shall operate
t o v acate his office. The conviction o f a n y person holding a n elective or
ap p o in tiv e office for a felony u nder t h e laws o f th is state , or of th e United
S t a t e s , shall o p erate to dismiss such officer.
