There is law-making in the Murray verdict. A code as ef fective and authoritative as the law evolved by legislative enact ment is the outgrowth of such incidents. Though unwritten, it is law, and is the product of civilization and man’s growing conception of what is right and what wrong. It is the uncon sciously created statute o f that final arbiter and court, public opinion. By it, seduction, under promise of marriage, stands condemned. Orlando Murray punished that offense with death, and a jury refuses to condemn his act. It refuses to permit him to be punished in any way, though he committed murder under the civil code when he slew the man who wronged his sister. It is only one more of a thousand verdicts of its kind, rendered since man started up the scale of civilization. It is only one further step in establishing the authority and majesty of the un written code. It is well, per haps, because it is the only means o f invoking a penalty to fit the crime. Juries would hardly hang the worst seducer, even were legislative statute pro vided. Some states p r o v i d e capital punishment for rape but convictions are practically un known because of the inborn sympathy of the men who sit in the jury box. So, a brother with stern pur pose, a cool head and a loaded revolver are of necessity the only means o f reaching the low hounds who gamble on woman’s honor and revel in woman’s downfall.
