decided the Hears Dunbar case;
bolding that Secretary of State
Dunbar was uot entitled to retain
any fees in excess of bis constitu­
tional salary. The decision is
based upon sectiou 1 of article 13,
which definitely fixes the secreta­
ry’s salary wend expressly declares
that he shall receive no fees Or per­
quisites whatever for the perform­
ance of any duties connected with
his office. Judge Galloway calls
attention to sectiou 10 of article 2,
which prohibits auy ¡teraon from
bolding more than one lucrative
office at the same time. These two
sections taken together preclude
the col lectio u of extra compensa­
tion.
This suit wan originally brought
by J. K. Bears to compel ex Secre
tiiry of State Dunbar to accouut for
fees collected by him and alleged
to amount to 9100,000. It was held
that Bears could not bring the suit,
and Diatiict Attorney McNary
then appeared on behalf of the
state. The defense then appealed
to the supreme court front the or­
der allowing the change in plaiu
tiffs but the supreme court held
that this was not an appealable or
tier. Defendant Dunbar theu filed
a d e n t i l tier and motion to strike
out part of the complaint, aud it
was upon thes^ that Judge Gallo
way rendered bis decision today.
