About twoo'clock in the1 afternoe Cooke went to Arlington and reportedthat Collins had been murdered, tie disclaimed any knowledge of who did it but from, his manner Coroner Kuedy suspected hiiu aitd bad him placed nuder arrest. '. Corotter Buedy, with nomlier of citi zens and with Cooke in charge of Con stable . Sweetin, then' repaired to the scene of the tragedy and began an in vestigation. A jury was empaneled and Cooke and Mr. and Mrs. Ashpaugh were examined separately. Cooke testified that he saw a stranger haul Collins to his house and carry him inside after which he drove away towards Arlington. That he went' to see what was the mat ter and fonnd Collins nearly unco neeious, gave hint a drink of water and left him. Went back at noon and found him dead. Ashpaugh testified that he helped Cooke take Collins to the bouse but that he heard no hots and did not know how Collins was hurt. Mrs. Ashpaugh was- then placed on the stand and she testi fied that she and her husband heard three shots and they remarked that per haps Cooke and Collins were having trouble. Ashpaogh was again brought in and upon being confronted with his wife's statement be admitted that Cooke killed Colli M. Cooke was again brought inandnpon being shown the statements of both the Ashpaugh' be broke down and confessed the murder. The coroner's jury returned a verdict of mnrder in the first degree. On Saturday Cooke was given a p-e- liminary hearing before Justice of the Peace Ebi, at Arlington St. -A. D. Gur ley appearing for the state and Judge A, S. IJennett, of the Dalles, for the defense. After hearing the evidence the justice took the matter under advisement until Monday at 10 o'clock a.m., at which time Cooke was held without bail to the cir cuit court. Kothing new in the way of evidence developed in the preliminary trial more than was brought out at the coroner's inquest, the. substantial facts of which are given above. Sheriff Wil cox went down Saturday morning to took after the matter and at the close of the preliminary hearing Monday morning that official took charge of Cooke and bronght him to Condon, where he is now lodged iu the county jail.
