The cost of providing a thirteenth man would be small, compared to the loss en tailed by frequent mistrial under the present system. The committee at work upon reform of judicial pro cedure should include this important feature in their program of revision, o In the passing of Judge Phelps, the state, district and bar are be reft of an able jurist and a fair minded lawyer, Umatilla county and the city of Pendleton a highly es teemed citizen and neighbor. Phelps the man, and Phelps the judge were identical in the measurement of hon or and uprightness in both spheres of endeavor, and that this man lived, the commonwealth is the better for his living. His passing on is but the commonest of events, but his de parture leaves an important niche in the judicial structure to be filled. Nine girls and eight boys gradua ted from Athena high school last Fri day evening midst impressive cere monies. Receiving their diplomas, they left their public school work measureably well equipped to enter upon the serious duties of life, inso far as it is possible for a high school education to assist them. It is the largest class that has ever graduated from Athena high school, and the community in general joins with parents and patrons in extending con gratulations. o The Interstate Commerce Commas sion has told the Northern roads to go ahead and pull the cork out of the railroad bottle which the Southern Pacific has been carrying around for years in its hip pocket, so to speak, and it begins to look like Central Oregon is about to come into her own, in acquiring transportation fa cilities that will take her away from home when she wants to go, and bring her back again without .being compelled to traverse around through the state of California. day, observing the owner placing a blanket over his radiator when he parked at the curb, exclaimed, "No use trying' to cover 'er up Mister, anybody kin tell it's a Ford!" o It was Mark Twain who said, mine is a hole in the ground with a liar on top." NOTICE OF FINAL HEARING Notice is hereby given that the un dersigned, as administratrix of the estate of Michael J. Ryan, deceased, has filed her final account and re port in said estate with the Clerk of the County Court of the State of Oregon for Umatilla County; and that the Judge thereof has fixed Wednesday, the 8th day of June, 1927. at the hour of ten o'clock A M. as the time, and the County Court room in the courthouse at Pendle ton, Umatilla County, Oregon, as the place for the hearing of objections to such final account and the settle ment thereof. A29M27, Admiral Sims, who always spoke in an outspoken manner, tells the Review of Reviews that the best thing to do with our battleships would be to send them as far as pos sible up the Mississippi river, out of harm's way, and fight our next war with submarines and aircraft. Looks like the old guy had been converted by Colonel Mitchell. o We read that forks were first used at the table in Italy in the latter part of the sixteenth century. Well today we know of places nearer than Italy where they have as little use for the fork as others have for the knife. Everybody up in Canada is jazzing around preparatory to a visit from the Prince of Wales in July. Saxa phones are being burnished and dance hall floors are receiving an extra coat of wax, for Wales is known to be a bloomin' good dancer. o We would be charged with neg ligence did we' not mention that llermiston sand still exists in suf ficient quantity to dust up Athena households when windstorms blow and Tuesday it certainly blew and blue. o Eugene is making prune shipments; dried. On the same page we read that J. Frost left enough green prunes on the trees at Milton-Free-water to fill BOO refrigerator cars. Not so bad from a prune standpoint, at that. No wonder the Germans are beer drinkers. Whiskey sells at from $17 to $24 a gallon on account of excise tax and the fact that the moon sel dom shines over there. With Umatilla county teams play ing in three leagues, it should be an easy matter to see a Sunday ball game. o Oregon at the top o' the heap again; Columbia county will supply the plunking to repair 'Old Ironsides." A Med ford prospector has filed on a cinnabar ledge one mile long on Squaw Creek not our Squnw creek, nothing but Rainbows there. The current rumor that Ford cars are to be equipped with gears, re minds us: A street urchin on a cold SUMMONS (Equity No. 4318) In the Circuit Court of the State of Oregon for Umatilla County M. L.
