men who will not pay their bills, said
W. F. Mahon, a lawyer of Chicago, who
has Just returned from a two months'
trip abroad, says the Washington Post,
"Imprisonmeut for debt was nominally
abolished in England many years ago,
Out, nevertheless, the actual number of
cases of imprisonment has since annu
ally Increased, proportionally faster
than the population. " Technically, the
imprisonment is for contempt of court
The judge orders the debtor to. pay
before a given day, failing which he
may be Jailed for contempt, not exceed
ing forty days, and in case he pays the
debt he is released at once. .
"The power of committal resides in
me Judge of the court Some judges
exercise it more freely than others. ; In
Nottingham county imprisonment, for
debt is rare, I am told. In other pop
ulous court districts with much ' more
court business the eases of imprison
ment do not exceed fifty a year, while
in some less populous districts with
less court business the number reaches
500 a year. It seems, however, that
the Indulgence shown to delinquent
debtors is steadily decreasing, for the
cases of imprisonment in the country
have Increased from about 5,000, in
1870, to more than 12,000 last year.
"Credit is not abused In England as
it Is in the United States, however.
Many men have credit of course, tut
the word meaua more In England than
it does in America. A man whose
credit is good must have earned a repu
tation for upright business honesty be
fore he Is trusted. Shopkeepers will not
credit a man who is not known person
ally to them as a man of good business
standing, and If recommended by an
other, they will by some subterfuge put
off the intending purchaser until they
can. find out whether the recommenda
tion is genuine. When credit is once
given, the person io whom it Is extend
ed Is not continually annoyed by the
receipt of bills."
Legal Information
The right of a physician called Into h
case as an expert to additional com
pensation is often insisted upon, and
sometimes questioned. In Burnett v.
Freeman, 103 Southwestern Reporter,
121,- the Kansas City Court of Appeals
collates numerous authorities on this
proposition, and comes to the conclu
sion that such an expert is not entitled
to. additional compensation for his ser
vices in a case.
The decision of Judge Dill of the
New J.ersey Court of Errors and Ap
peals In Vanderbllt v. Mitchell, 67 At
lantic Reporter, 07,t serves admirably to
illustrate that the powers of a court of
equity are adequate to meet the de
mands made thereon by constantly
changing social conditions. In this
case It appears that a birth certificate
was made by the physician present at
the birth of a child. This certificate
set forth, among other things, the time,
the date and place of the birth of the
child, the name of each of the parents,
the maiden-name of the mother, and
the name of the child. It appears that
in making the certificate the physician
was Imposed upon by false statements
of the mother as to the paternity of
the child, and cei tWed, contrary to the
fact, that complainant in this suit was
the father of the child. Judge Dill
holds that the court has power to cor
rect the record.
The extensive development of lnter
urban railroads Is gradually narrowing
the distinction between the rights of
commercial railroads, or so-called stenm
railroads, and street railroads proper,
as lnterurban roads in many instances
partake of the nature of both. In Kln
sey v. Union Traction Company, 81
Northeastern Reporter, 922, decided by
the Indiana Supreme Court, one of the
main contentions was whether or not
lnterurban cars, operated on the streets
of a city with its permission, for the
carriage of passengers, express, and
light freight, by a corporation unorgan
ized under the 6treet railway laws, con
stituted an additional servitude on the
streets so as to entitle abutting owners
to additional compensation for the use
of the streets. Three of the Judges,
Chief . Justice Hadley, Justices Gillett
and Monks, were of the opinion that
the operation of the cars did not con
stitute an additional servitude, while
two Judges, Justices' Jordan and Mont
gomery, held the contrary. '
