WILL GO AGAINST PROHIBITION
Saloon Men Will Bring Suit Prohibi
tionists Will Close Saloons.
That tbe saloon men are going to
fight prohibition to the last ditch
through tbe suit which they brought
last week is tbe announcement made
by several of them, says tbe Pendleton j
Tribune The refusal of Judge Bean '
to grant tbem tbe temporary injunc
tion as prayed for bas not deterred
tbem in their determination to fight it
out, even if tbey have to close tbeir
dqors while tbe question is being ap
pealed to tbe supreme court.
Tbe main contention upon which tbe
suit is based, outside of tbe constitu
tionality of tbe initiative and referen
dum, is that tbe county court was not
in session at tbe time tbe order for
submitting tbe question to tbe people
at the June election was signed and
issued. And on this point tbe plaintiffs
contend that tbe offioial reoords of the
minutes of tbe county court bear them
out. This record, it is claimed, shows
that tbe county court did not convene
until Mar 6 in regular monthly ses
sion, having adjourned previously on
April 4, whereas the order submitting
tbe proposition to tbe voters was signed
and issued on May 2. or four days be
fore tbe county court was in session.
While this is but a technicality yet
tbey contend that as the prohibition
law is purely statutory every step in
the prooedure must conform to tbe
mandatory direction of the law, and
failure iu this part makes the law in
valid.
On tbe other hand tbe prohibition
people say that tbey took great pains
to see to it that everything was done
as tbe law requires and tbey will
provide counsel to -fight tbe oase clear
through to tbe end, and will also see
to it that tbe saloons close up during
tbe time tbe case is being appealed.
While tbe attorneys for tbe plaintiff
do not direotly say so yet it is believed
tbat tbey intend to go to the United
States supreme court on tbe constitu
tional question if they lose out in the
state courts.
Arguments in tbe case were made
yesterday before Judge Bean, Attor
neys Winter, Richards and Lowell ap
pearing for tbe saloon men and Dis
triot Attorney Phelps for tbe oounty
and state.
