B. Moorehead at Wallula about two mouths ago. Twenty-seven names were drawn before the jury was seleo ted, only lour men objecting to capital punishment. Mcintyre alleges self defense as justification. Moorehead was killed by being struck in the bead with a slungshot made from a rock tied in a handkerchief. The testimony showed that Moorehead and Molntyre had trouble before. Some of the state's evidence is good for the defense, as it was shown that Moorehead had threat ened the life of Mcintyre. Practioally no interest is taken in tbe case, not over 80 or 40 spectators being present. After ten minutes' deliberation tbe jury returned a verdict of not guilty. The trial of Ed Sinclair for the kill ins of Gust Kotsovos was set for vea- terday. I - , , J THE SCHOOL TO CLOSE Perryman's Incompetency Disrupts the High School It ia understood that tbe board of directors has deoided to close the Athena publio sohool on Friday, April 26, or one month earlier than usual. ' This aotioa U doubtless the result of taking into consideration the deplor able condition in which the high sohool department is fonnd. The higher grades of tbe sohool have diminished until there are bat six pupils left in the 9th grade. The 10th and 11th grades have melted entirely away, the last foot pupils iu those grades leaving school in a body, Mon day of this week. No criticism is heard regarding tbe work iu the lower grades, but it has been known for months that conditions, iu the higher departments were snob that it would have been better for all concerned, bad they been olosed long ago. The patrons of tbe sohool who have ohildren attending this department are praotioally unamnious in declaring that the head of the sohool. Prof. Perryman is incompetent; is inoapable of enforcing discipline and that the cbaotio method in which be conducts his department, has extended to and more-orless affects the work in the lower grades. " It is reoognized , f hat the directors have erred to some extent, iu not rais ins tbe salary of urinoipal to corres pond with wages paid in other towns of Athena's size and prominence, which would have attracted competent talent in applying for the prinoipal ship of the sohool here. The salary paid here this year un der a 15-mili tax, is $85 per month. As against $100 to $150 per month paid to prinoipals in other schools of like imbortanoe. it is easy to see where Athena is getting the worst of it, in SALTPETER IM CURED MEATS Commission Will Shut Up Men in Club Boom and Feed Them. A dispatob from Urban 111., says: "It is tbe plan of tbe commission to make the most elaborate tests ever made in the country to determine tbe effect of the saltpeter contents of cur ed meat upon tbe health," said Presi dent James of the University of Illi nois an disoussing the work of tbe na tional food commission. "Tbe work," be added, "is under taken at the solicitation of tbe packers themselves, who bave long wanted to know whether or not saltpeter when consumed iu small quantities is injur ious. "Tbe investigation will be carried on at the University of Illinois under tbe direot supervision of Professor Grandley of tbe University. A squad of 20 men will be boused at a club un der tbe most favorable conditions. Half of the men will be fed meat oared in tbe ordinary way and tbe others on exaotly tbe same diet except that tbe meats will not contain any saltpeter. A doctor will examine tJbe men daily, and their weight and physical condi tion will be carefully noted. Toe in vestigations will extend over six months and the results will be accurate in every particular. "Tbe men oomposing tbe commission are tbe most noted in tbe country. They will direct the work and their presence on tbe commission insures that the results achieved will be final. Tbe work is of great importance. Owing to the immense amount of cur ed meats consumed in tbe country it is imperative that the people know of tbe injurious or non-injurious use of salt peter." As soon as tbe saltpeter investigation is finished other work ia connection with nutritive problems will be under taken. Defeat New Water System. At a speoial city election held Satur day in Enterprise, tbe $30,000 bond for tbe new water system was defeated by a vote of 79 in favor as against 68. A two-thirds majority was neoessary to carry the measure, wbicb was de signated as tbe E. M. and M. fran chise, it having been refused by the council last Friday. Department. largo doses. But which is the more expeusive consid ering a good sohool to be the principal asset of a town, in that it attraots de sirable people to reside iu it the pay ment at one swoop of the bonded in debtedness, wbiob draws as low as 5 per oeut interest, and to do so, killing the sohool, or; leaving a portion of the indebtedness stead at a low rate of in terest, pay deoent salaries and bave a good sohool, thus offering the main inducement for people to make their homes here? Under such men as Jar vis, Reid, Watts and Marquis, the Athena school ranked with the best in Eastern Ore gon. What a coutrast exists under the present regime. With absolutely no discipline; no system or order, is it-any wonder that the reins of sohool gov ernment in Athena have snapped and lie dormant to the extent that pations have taken their children ont, and iu some instances are sending them to oountry schools? And not beoause these ohildren ate less amenable to school rule or disoipline thau scholars were in the days of Jarvis, Reid, Watts or Marqnis, can present condi tions be attributable, but beoanse it's a mere matter of fact that they were left to snift for themselves, despite the counseling of members of tbe board with the priLoipal that the rules and regulations of tbe school be enforced. Tbe announcement that tbe educa tional fiasco iu Athena is to be drawn to an early close is received with uni versal gratification, and out of tbe dregs of the dismal failure is drained tbe impressive, though expensive les son, that hereafter prinoipals of the Athena public sohool are to be worthy of their hire. REPUBLICANS WIN IN CHICAGO Fred Basse, Republican, Elected Over Edward Dunne. Democrat. The most sensational munioipal campaign Chicago has cxperieuoed in many years closed Tuesday night with tbe election of Fred Busse, tbe repub lioan candidate for mayor over Edward F. Dunne, bis demooratio rival for re election, by a plurality of between 11,000 and 18,000. The issues in the oanipaign bave been largely based on improvements of tbe local truotiou sys tem. Both parties were agreed that the presont conditions were intolerable but differed as to tbe best method to be employed in revising them. Tbe democrats, headed by Duune, stood for munioipal ownership through condemnation of tbe street car proper ties if result could not be obtained iu any other way. The republican party favored the ordinances which were recently passed by tbe democratic counoil over Dunne's veto. These ordinances provide for twenty year f ranobises, the city retain ing the right to pnrchase tbe system for $30,000,000 plus the amount spent for immediate rehabilitation of tbe lines, six months notice being neces sary to aoquire the property. The fight for and against these or dinances by a referendum vote bas been exoeedingly bitter. They were carried by a majority of about 40,000 votes. Doing Business Again. A Pendleton dispatch to the Spokesman-Review says: In anticipation of the convening of the federal grand jury ' in Portland during the present week, because it is believed that the Umatilla land fraud cases are to be in the list of in teresting topics, the atmosphere here is surcharged with the feeling that this city is to be made the center of one of the most startling land fraud scandals yet unoovered. Government agonts have been work ing constantly in this section for many months. It is known that if the ru mors of "big deals" having beeu pulled off in recent years are found to be correct, the prosecutions which will follow tbe findings of the grand jury will involve the highest rated flnanoiers in the Inland Empire. Federal Insneotora Dixon and Alex ander have been at work quietly for many months in and about Pendleton gathering facts that have to deal with the illegal gobbling up of government lanas. Has New Vinegar Process. The new vineear nlanfc established at tbe farm of the Blalook Fruit com pany near Walla Walla, last fall, and tbe only one of the kind west of the Kockies and the seooud or third in the United States, is now in operation. The process of fermentation ia a rad ical departure fiom any heretofore employed. Round vats 10 feet high and fonr feet in diameter are tispd for this purpoeo, and instead of being left ; open tor trie air to aot upon tbe con tents and the fermentaion nrodnoed bv the ancient process, the vinegar eel is employed to transform the sweet cider into vinegar. The Griffin antigani bling law be came effective iu Montana Monday, and as a result all games of chance are strictly tabooed. It is the first time since the discovery ot gold in 1863 that nowhere in that state can a publio game of faro, roulotto, poker, dice, card games of all kinds, and even slot maohines be found. All the latter were removed from oigar stores and other establishments and hereafter the transfer of goods and merchandise will be a strictly commoroial affair. ' FREEWATEB WANTS THE ROAD Steps Also Taken to Secure a Good Hotel Buildine;. " An important session of tbe Free- water Commercial association was'held Saturday evening, at which $125 'was reported subscribed toward the opening up of Wasbmgton stroot and $25 was pledged by the clob itself to insure the immediate furtherance of this move ment. The opening of the Hudson Bay road directly into that city was dissoussed, and h. P. Jenson and Frank Holiuan offered 20 feet of land 80 rods in length along tbe Hudson Bay ditch f 6r $200 towards tbe consummation of the scheme. The need of a modern hotel in Free- water was brought up, and a commit tee was appointed to immediately take the matter up and select a suitable site for such a building. Chas. L. Swain, Mayor Evaus and C. T. Godwin were named as a committee. A stock oompany will likely be incorporated and the building constructed soon. ' Students to Fight Sheep Disease. Four Oregon Agriculture Colleno students are leaving college today to take positions on tbe Government staff for eradicating sheep diseases in Ore goo. They are G. A. Dodson, Walter Foster, Edcar W. Donnelly and Hourv Rooper. Tbey receive good salaries and bave their expenses paid. The work will extend from now to the end of tbe summer. Their appointments are reoeived from tbe bureau of Ani mal Industry at Washington, Dodson, Donnelly and Foster are to operate in Eastern Oreeon and Roontr in thn Wil lamette Valley.
