address at the opening of the third
Pan-American comm ercial conference.
F our hundred delegates from th e
U nited S tates and the 20 Latin A m er­
ican republics listened to the secre­
tary'« welcome, In which he stressed
th e "unity of purpose and unity of
Ideals" of the American nations.
“The more I study th e conditions
of this continent," Kellogg said, "th e
m ore I am Im pressed with the fact
th a t the basic principles underlying
the civilization of all the republics of
A m erica are essentially the sam e. The
points of resem blance th a t u nite us
are far more num erous and far m ore
Im portant than any difference th a t
may exist.”
Kellogg defined Pan-A m ericanism
as “far deeper than the existen ce of
friendly relations betw een govern­
m ents.” It means, above all things,
he said, a m utually sym pathetic un­
derstanding of national Ideals and
purposes between the peoples of this
continent.
"We are anxious," he continued,
“th at this hem isphere shall give to
th e world an exam ple of orderly prog­
ress, of m utual respect for rights, and
th a t there shall also be a m utual ful­
fillm ent of obligations. It is only on
such a basis th a t real and perm anent
progress can be assured.”

a Judicial decision reached on th e con­
stitutionality of th e in itiativ e m eas­
ure, adopted by the voters of Oregon
last November, abolishing all wheels
and traps.
The re strain in g order w as issued in
response to the petition of P. J. Mo
Gowan & Sons, a W ashington corpora­
tion which operates fish wheqjs on the
Oregon shore of the Colum bia river
in Hood River county.
The McGowans asked the court to
restrain the s ta te of Oregon from en ­
forcing the law which was to have
gone into effect with th e opening of
the salmon com m ercial fishing season
on the ground th a t it w as in violation
of a com pact entered into by W ashing­
ton and Oregon in 1915 and ratified
by congress in 1918. T his compact
regulates fishing seasons and m ethods
on the Colum bia and Its term s can
only be changed by the m utual con­
se n t of both states.
It was also set up by the petitioner
th a t the Oregon law is a violation of
the federal constitution in th a t it pro­
vides for the confiscation of property
w ithout due process of law.
