The case w ill lie an expensive one, ai
large number of witnesses having been ,
suminonv«! from along the boundary |
line (»etween Oregon and California. The
evidence will be like that ot the Durrant
case, entirely circumstantial, and nearly
five months elapsed between the time of
the niurdei and the arrest of the ac
cused. The body of Chas. Perry was
found in an old well at a deserted stage
station known aa Bain’s an I Ibis spot is
75 ya rile across the line in Curry county
and hall a mile north of the California
boundary.
The theory of the prosecution is tliat
Melson and Perry were traveling togeth
er in the wilderness near Bain’s station
and that Melson shot Perry and dragged
his Is^ly to the well where it was after
wards found Melson sold Perry's watth
for |4 to W. B. Eddings who took care ol
stage horses not far from Bain’s station,
Melson asserting that he had bought the
watch for |25 in Portland. Melson after
ward state«I that Perry had given him
thtY watch a* a parting gift. The de
fense maintained this latter statement
in its rebuttal.
During the trial which was well-atten
dvd, Melson sat between his attorneys
apparently indifferent to evidence or the
clashing of prosecution and defense over
points cl law. He is not adesj»eia’e-
looking man, but one of rather dull com
prehension, judging from his demeanor
since his imprisonment.
There was no break in the chain of
strong circumstantial evidence which
wouud about the accused, and in spite of
Mr. Crawford’s able ami impassioned
plea, the jury which went out at 10 P. M.
returned a verdict of “guilty of murder in
the first degree” al 1 A. M. Wednesday
morning Judge Hanna being called up to
receive it.
Mr. Jeffries iu his conduct oi the case
showed skill and force. Both his open
ing and closing addresses for the prose
cution exhibited a thorough knowledge
of the matter in hand.
Melson gave no outer sign of mental
excitement when the verdict was made
known. He held his hands up for depu
ty Fallen to put oh the manacles, with
out a tremor or a "Hmch. The verdict
gives genera1 satisfaction to those who
heard the evidence.
The jurv on first ballot stood 10 to 2
the 2 being for the second degree. On
second ballot it stood 11 to 1, and finally
all jurors agreed. Judge 1 lamia will
pass sentence Friday.
Melson enticed Perry to the isolated
$pot at B.tin’s station, using as a bait
tlie tale that he, Melson, hud a placer
mine which paid 25 to 50 cents lo the
pan, and while both were in bed, shot
I’erry through the body with a 41 cali
ber Colt revolver and after tying stones
to the murdered man’s feet threw the
body into the old well.
He told 4 different tales as to what had
l»ecome of Perry, saying that he had
gone in various directions A cartridge
was found near the well exactly fitting
Melson's pistol and the dent made in it
by the hammer also fitted exactly, the
[»oint of the hammer having been filed of!
by someone and making a mark on the
cartridge peculiarly its own.

there is no sign of getting through. This
means a chlorination plant in the All-

Experts said blester was crazy and
wouldn’t live a month, but the old man
is stout and hearty as ever he was. Thin
shows the value of “expert testimony”
in such cases.
Fiester has been removed to steel cells
where he will he more secure. One reas
on the supreme court has not pushed
his ease is that he was reported insane.
He told Mr. Fallin yesterday “Well you
hadn’t ought lo kick ; you've had a goal
thing out of it.” Most of us would not
consider the <lirty job any “good
thing.”
