Section 1. Purpose and Intent. The Board of Commissioners (“Board’) for the Falcon Cove Beach Domestic Water Supply District (District’) hereby declares that a water shortage emergency is expected to prevail during certain months (‘Critical Shortage Months’) within the District due to a seasonal reduction in supply, and that the ordinary demands and requirements of water consumers cannot be satisfied during these Critical Shortage Months without depleting the District’s water supply to the extent that there would be insufficient water for human consumption, sanitation and fire protection. Therefore, in order to conserve the water supply for the greatest public benefit with particular regard to domestic use, sanitation and fire protection, the Board adopts the following regulation and restrictions on the delivery and consumption of water to take effect at intervals and at such times as determined by action of the Board. Section 2. Definitions. For the purpose of the Ordinance, the following terms have the meaning given: ‘Customer’. Any person using water supplied by the District. ‘Person’. Any person, firm, entity, partnership, association, corporation, company, or organization of any kind. ‘Water’. Water supplied by the District, unless expressly provided otherwise or required by contract. Section 3. Application, The provisions of this Ordinance shall apply to all customers using water provided by the District. Section 4. Non-essential Uses. During Critical Shortage Months as determined by the Board, the following uses shall be considered non-essential. No Person or customer shall: A. Sprinkle, water, or irrigate any shrubbery, trees, lawns, grass, c=ground covers, plants, vines, gardens, vegeta- bles flowers or any other vegetation. B. Use water to wash any motorbike, motor vehicle, boat, trailer, or other vehicle. C. Use water to wash down any sidewalk, walkway, driveway, parking lot, tennis court or other hard-surfaced area, or building or structure. D. Use water to fill, refill or add to any indoor or outdoor swimming pool or hot tub, except where the pool or hot tub has a recycling water system and a cover to prevent evaporation, or where the use of the pool or hot tub is required by a medical doctor’s prescription. E. Use water in a fountain or pond for aesthetic or scenic purposes except where necessary to support fish life. F. Use water for dust control. G. Cause or permit water to run to waste in any gutter or drain. Section 5. Discontinuation of Service. The District may, five (5) days after delivering one warning by certified mail or in person, disconnect the water service of any person or customer what whenever that officer determines that such person or customer has failed to comply with any provisions of this Ordinance. Service so disconnected shall be restored only upon payment of the turn-on charge, hereby fixed at $100, together with any other costs incurred by the District in discontinuing the service. In addition to the foregoing, the District may, prior to restoration of service, install a flow restrictive device on the customer’s service. Section 6. Variances. The District may, in writing, grant temporary variances for prospective uses of water oth- erwise prohibited after determining that due to unusual circumstances to fail to grant such variance would cause an emergency condition affecting health, sanitation or fire protection of the applicant or public. The Board shall ratify or revoke any such variance or adjustment at its next scheduled meeting. Any such vari- ance or adjustment so ratified may be revoked by later action of he Board. No variance shall be retroactive or otherwise justify any violation of this Ordinance occurring prior to issuance of the temporary variance. Section 8. Ordinance Controlling. The provisions of this Ordinance shall prevail and control in the event of any inconsistency between this Ordinance and any other rules or regulations of the District. Section 9. severability Clause. If any part of this Ordinance is for any reason held to be unenforceable, the re- maining portion of this Ordinance shall remain in effect. Section 10. Publication. The Board shall cause this Ordinance to be published for the period and in the manner required by ORS 198.550(3), and a certified copy of the signed Ordinance shall be filed in the records of the Dis- trict and with the Clatsop County Clerk. ADOPTED THIS 10th day of November, 2018, by a unanimous and full Board vote.
