M114 challenge fi led in federal court

PENDLETON — Sherman
County Sheriff Brad Lohrey on
Friday fi led a federal lawsuit to
prevent voter-approved fi rearm
restrictions from taking eff ect.
Lohrey was joined in the
Nov. 19 fi ling by the Oregon
Firearms Federation and Adam
Johnson, a Marion County gun
store owner.
The suit was fi led in the
Pendleton Division of the U.S.
District Court for the state of
Oregon. It contends the ban on
magazines that hold more than
10 rounds violates their Second
Amendment right to bear arms
and right to due process.
Ballot Measure 114 was
approved by a margin of 51%
to 49% at the Nov. 8 election
and is scheduled to take eff ect
Dec. 8. It also would require
a permit to buy a gun and will
close the so-called “Charles-
ton loophole” by requiring a
criminal background check be
completed before a gun sale or
transfer can occur.
The role of the sheriff in
the lawsuit is not a surprise.
As previously reported, many
sheriff s across the state oppose
the new restrictions in the
measure and say they will not
enforce them.
Even statements from the
Multnomah County Sher-
iff ’s Offi ce and the Deschutes
County sheriff were more about
evaluating the measure, rather
than a straight “yes,” when
asked if the new law will be
enforced.
In response to a ques-
tion about whether incumbent
Multnomah County Sheriff
Mike Reese or incoming Sher-
iff Nicole Morrisey O’Don-
nell will enforce Measure 114,
sheriff ’s spokesperson Chris-
tina Kempster would only
say, “The Multnomah County
Sheriff ’s Offi ce is evaluating
how Measure 114 may impact
operations. We will be work-
ing with lawmakers, key stake-
holders and our public safety
partners to determine how to
best implement a system that
meets the requirements of
Measure 114.”
Deschutes County Sheriff
Shane Nelson said in a state-
ment that enforcement of Mea-

sure 114 would not be a priority
for his offi ce. Other rural Ore-
gon sheriff s, including Jeff er-
son County Sheriff Jason Pol-
lack, have said they would not
enforce the law.
Grant County Sheriff Todd
McKinley declined to say
whether or not his offi ce would
enforce Measure 114. McKin-
ley did say, however, that he and
his deputies would “exercise
our discretion” when it comes
to enforcing the measure.
“Banning magazines over
10 rounds is no more likely to
reduce criminal abuse of guns
than banning high horsepower
engines is likely to reduce
criminal abuse of automo-
biles,” the lawsuit reads in part.
“To the contrary, the only
thing the ban contained in
114 ensures is that a crimi-
nal unlawfully carrying a fi re-
arm with a magazine over 10
rounds will have a potentially
devastating advantage over
his law-abiding victim,” it
continues.
Oregon Attorney General
Ellen Rosenblum has vowed
to defend the measure against
lawsuits.

Circuit Court
Nov. 17
Justin Scheidegger, 28, of John
Day pleaded guilty to driving under
the infl uence of intoxicants. Addi-
tional charges of felon in posses-
sion of a fi rearm and unlawful pos-
session of a fi rearm were dismissed.
Scheidegger was given a suspended
sentence but was placed on bench
probation for two years and ordered
to complete 80 hours of community
service or work crew time. He was
also ordered to complete the Victim
Impact Panel program, obtain a sub-
stance abuse evaluation and com-
plete all recommended treatment,
and not to use or possess intoxicants
during the period of his probation.
His driver’s license was suspended
for one year, and he was fi ned $250.

a single-vehicle non-injury crash.
A Cadillac SRX went off the high-
way and down a steep embankment,
coming to rest on its wheels in the
John Day River. The driver was on
crutches and told the trooper he had
numerous medical issues. He said
he believed he fell asleep or blacked
out, causing the crash. Jon T. Mars,
62, of Spray was cited for failure to
drive within a lane and will be put
in for a driver evaluation. Grant
County Sheriff ’s Offi ce and Oregon
Department of Transportation also
responded.

12:15 a.m.: Olle Leroi Starnes,
52, of John Day was cited in lieu

7:45 a.m.: A trooper responded

to dispatch an injured deer caught
in a wire fence. A fi sh and wildlife
trooper processed the deer for sal-
vage. Four quarters and two back-
straps were taken to Russell’s Meats
in Canyon City for donation to the
Grant County Food Bank.

Jeep Cherokee for multiple traf-

Avenue and Bridge Street, John
