NOTICE OF PUBLIC HEARING
Notice is hereby given that the Grant County Court will conduct a
Public Hearing on January 22, 2020, beginning at 10:30 a.m. at the
Grant County Court, Court Room, 201 S. Humbolt Street, Suite 280,
Canyon City, Oregon on the following Land Use matters:
1. Public Hearing to address Appeal ACC-19-01, submit-
ted by Philip Wirth to appeal the decision of the Planning Commis-
sion on application AR2-19-11 to create two non-farm parcels and
place a dwelling on each parcel. The property is identified as tax lot
2300, located at Township 9 South, Range 28 East, Section 29, W.M.
consisting of 40 acres located in the Multiple Use Range Zone.
The appeal hearing is on the record, and no new information may
be presented. Only parties with standing will be allowed to present
testimony on the record. Persons or parties interested or concerned
with this subject matter may appear in person before the Grant
County Court on January 22, 2020, beginning at 10:30 a.m. at the
Grant County Court, Court Room, 201 S. Humbolt Street, Suite 280,
Canyon City, Oregon. Written testimony based on information in the
record from parties with standing must be received in the Planning

the public hearing. Failure of an issue to be raised at the hearing or
by letter, or failure to provide sufficient specificity to afford the deci-
sion maker an opportunity to respond to the issue precludes appeal
to the Land Use Board of Appeals (LUBA) based on that issue. Cop-
ies of the appeal are available for public review at the Grant County
Planning Department not less than seven (7) days prior to said hear-

Land Acquisition Grant Program, concerning approximately 1,642
acres in the vicinity of Prairie City,
Grant Application No. 220-9903-17344.
The Oregon Watershed Enhancement Board (OWEB) is a state
agency that provides grants to help Oregonians take care of local
streams, rivers, wetlands, and natural areas.
OWEB is considering a grant of funds to the Blue Mountain Land
Trust for the purpose of purchasing certain property rights on ap-
proximately 1,642 acres in the vicinity of Prairie City, in Grant Coun-
ty, under Grant Application No. 220-9903-17344. OWEB will hold
a conservation easement, or third party rights of enforcement in a
conservation easement, if the property rights are purchased with
OWEB funds.
OWEB will hold a public hearing for the purpose of providing interest-
ed parties with a meaningful opportunity to comment on the OWEB
grant application. Questions or comments about the grant applica-
tion, or public hearing, are to be directed to the OWEB representa-
tive identified below.
The hearing will be held January 13, 2020 at 2:00 pm, in the Prai-
rie City – City Hall Council Chambers, 133 South Bridge Street,
Prairie City, OR 97869.
Requests for special accommodations in order to participate in the
public hearing must be made at least seven (7) days prior to the
hearing.

NOTICE OF PUBLIC HEARING
Notice is hereby given that the John Day Planning Commission and
John Day City Council are considering the following land use ac-
tions, as described herein:
CONDITIONAL USE PERMIT (TYPE III PROCEDURE) CUP 19-
03
Steve and Kathy Smartt are the owners of 212 Valley View Drive
(Map Number 13S31E22A Tax Lot 1066). This property is zoned
Residential General (RG). Mr. Smartt is requesting a Conditional
Use Permit to build an accessory structure exceeding the size re-
quirements permitted by the city development code. The Code al-
lows accessory structures with a permitted use to be built no taller
than 14 ft. and no larger than 1,000 sq. ft. of building footprint without
a Conditional Use Permit. Mr. Smartt’s proposed building would be
30x40 ft. with a height of approximately 18 ft.
LAND PARTITION (TYPE III PROCEDURE) LP-19-03
Sally Knowles owns the property at 603 NW Canton Street (Map
Number 13S31E23CA Tax Lot 2600) which is zoned Residential Lim-
ited. The owner wishes to partition this property into two parcels:
one parcel of .81 acres and the other approximately .38 acres. Land
partitions larger than one (1) acre shall be processed using a Type
III procedure under Section 5-4.1.040 of the City of John Day Devel-
opment Code (the “Code”), which requires a hearing before the John
Day Planning Commission prior to approval of the preliminary plat.
SITE DESIGN REVIEW (TYPE III PROCEDURE) SDR 19-05
The Heart of Grant County is a nonprofit organization that works with
survivors of domestic violence. The organization owns a vacant lot at
115 NW Bridge street where they seek to build a 3,472 sq. ft. building
comprised of offices, meeting space, and living quarters to provide
resources and emergency shelter to survivors of domestic violence.
REVIEW OF CI-16-01
The John Day Planning Commission will be reviewing a class B
variance granted to Riverside Mobile Home Park on November
7th, 2016. The variance, which authorized Riverside Mobile Home
Park to place single-section manufactured homes that do not meet
the minimum size requirements of the John Day City Development
Code, is currently in a state of suspension. The variance is being
reviewed on the grounds of noncompliance after an inspection by
the city concluded that roof pitch requirements, thermal envelope
requirements, floodplain development requirements, and building/
placement permit requirements had been violated in multiple in-
stances. These violations may be grounds for revoking the variance.
The property which includes 23-acres of mobile home spaces is
zoned General Commercial.

Staff Report on the subject application will be available for inspec-
tion not less than seven (7) days prior to said hearing at no cost;
copies will be provided upon request at a reasonable cost.

Written comments received or presented in person to Nicholas

uary 10th by 4:00 p.m. will be considered in rendering a decision.
Issues must be addressed with sufficient specificity based on criteria
with the John Day Development Code, upon with the City Council
must base its decision. Failure to address the relevant approval cri-
teria with enough detail may preclude you to appeal to the Land Use
Board of Appeals or Circuit Court on that issue. Only comments on
the relevant approval criteria are considered relevant evidence. All
evidence relied upon by the City Council to make this decision is in
the public record, available for public review. Copies of this evidence
can be obtained at a reasonable cost from the City of John Day, 450
East Main Street, John Day, OR 97845.
