NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND
NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural
requirements for activities to be undertaken by the City of Mount
Vernon.
REQUEST FOR RELEASE OF FUNDS
On or about June 10, 2019 the City of Mount Vernon will submit a re-
quest to the Oregon Business Development Department the release
of federal Community Development Block Grant funds under Title
I of the Housing and Community Development Act of 1974 (PL 93-
383), as amended, to undertake a project known as Mount Vernon
Wastewater System Improvement Project for the purpose of bring-
ing the City’s sewer utility into compliance with state and federal
regulations. The proposed wastewater system and treatment plant
project was developed as Alternative E, Collection System Upgrade
and Aerated Lagoons with Direct Discharge, Phase I, per the 2013
Wastewater Facilities Plan. The project includes:
a.) Treatment facility repairs and upgrades. The upgrades undertak-
en with this project at the facility are to correct existing problems, de-
ficiencies, and worn-out components. Facility repairs and upgrades
at the existing wastewater treatment facility is be located entirely
within City-owned and previously-developed property. The footprint
of the treatment plant will not be altered. Stormwater will not increase
or decrease as a result of the wastewater treatment plant work.
While this project will upgrade elements at the wastewater treatment
facility, it will not upgrade (sealing/lining) the treatment ponds or add
any other treatment process upgrades (such as aeration, nutrient
removal, disinfection, etc.) at the facility.
b.) Collection system rehabilitation and repair, which will include four
river crossings. The collection system improvements were selected
to address the most critical system needs, which will reduce I&I flows
and extend the useful life of the system. Collection system rehabil-
itation will take place on existing infrastructure elements all within
the City Limits of Mount Vernon. All rehabilitation of collection lines
will be completed using trenchless repair methods that will access
the elements through manholes. All manholes in the City will also be
rehabilitated or replaced, the contractor will choose either lining the
manholes or full excavation and replacement. All excavation will take
place within the road right-of-way. There are four river crossings as a
part of this the collection system rehabilitation and the details of the
crossings are included below.
Crossings #1, #2, and #3 will be completed with trenchless repair
methods and Cure-in-Place Pipe (CIPP). There will be no project im-
pacts to riparian vegetation. The construction will access the existing
sewer lines on each side of the River through the existing manholes
for trenchless rehabilitation with rehabilitation or replacement of the
manholes in the existing locations. The existing manholes are out-
side the riparian vegetation area and easily accessed with existing
transportation infrastructure and gravel access roads. Equipment
needed for CIPP trenchless rehabilitation is minimal. Crossing #4
will cross Beech Creek, but it will be hung on the existing access
bridge and insulated – no need for boring, excavation, or in-water
work. The crossings will not require excavation or boring because
sewer lines already run under John Day River and Beech Creek. For
the proposed river/creek crossings, no in-water work is planned for
these crossings in updating the infrastructure.
CIPP/trenchless rehabilitation of piping involves casting a pipe-with-
in-a-pipe system that lines the inside of the old, deteriorated collec-
tion pipes. The work requires no ground disturbance or digging and
it conducted out of trucks that will pull up next to the manholes. The
trucks will be able to conduct the work from either existing gravel
access roads or paved streets.
The CIPP/trenchless construction will be in accordance with Sec-
tion 00412 of the Oregon Standard Specifications for Construction,
which specifically covers the CIPP process. Oregon Standard Spec-
ifications specifies material properties of the tube, resin and liner
properties. HECO, Inc.’s experience in this region is that the big
manufacturers, such as Insituform, use a polyester resin. Specifica-
tions also allow vinylester or epoxy resin. The “wet-out” process is
typically done in a factory and the liner tube arrives to the site in an
enclosed truck, ready to install. A qualified contractor installs the
CIPP tube and cures it with steam or hot water from the inside of
the tube in a bladder. Any excess resin is contained in the pipe and
collected at the downstream end.
c.) Sewer line extensions constructed. One extension will be located
between Farra Lane and Rim Rock Lane in the North of the City.
The other extension is located on Hwy 395 north of the City. The
extensions will provide sewer service to current City residents that
only have municipal water service. It is not located near a river or
fish-bearing stream.
FINDING OF NO SIGNIFICANT IMPACT
The City of Mount Vernon has determined that the project will have
no significant impact on the human environment. Therefore, an Envi-
ronmental Impact Statement under the National Environmental Poli-
cy Act of 1969 (NEPA) is not required. Additional project information
is contained in the Environmental Review Record (ERR) on file at:
City of Mount Vernon (City Hall), 199 W Main St, Mt Vernon, OR
97865, and may be examined or copied Monday-Thursday 9 A.M to
4 P.M upon request.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on
the Environmental Review Record to the City of Mount Vernon (City
Hall), 199 W Main St, Mt Vernon, OR 97865. All comments received
by June 8, 2019 will be considered by the City of Mount Vernon prior
to authorizing submission of a request for release of funds. Com-
ments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Mount Vernon certifies to OBDD that Kenny Delano in
his capacity as Mayor of Mount Vernon consents to accept the ju-
risdiction of the Federal Courts if an action is brought to enforce
responsibilities in relation to environmental review process and that
these responsibilities have been satisfied. The legal effect of the cer-
tification is, upon its approval, the City of Mount Vernon may use the
Grant funds, and OBDD will have satisfied its responsibilities under
the National Environmental Policy Act of 1969 and related laws and
authorities.
OBJECTIONS TO RELEASE OF FUNDS
OBDD will accept objections to its Release of Funds and the City
of Mount Vernon certification for a period of fifteen days following
the anticipated submission date or actual receipt of the request for
release of funds (whichever is later) only if they are on one of the
following bases:
A. The certification was not executed by the Certifying Officer of City
of Mount Vernon
B. City of Mount Vernon has omitted a step or failed to make a deci-
sion or finding required by HUD regulations at 24 CFR Part 58
C. City of Mount Vernon has committed funds or incurred costs not
authorized by 24 CFR Part 58
before approval of a release of funds by OBDD
D. Another federal agency acting pursuant to 40 CFR Part 1504 has
submitted a written finding that the project is unsatisfactory from the
standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the
required procedure (24 CFR Part 58), and shall be addressed to
OBDD at 775 Summer Street NE, Suite 200, Salem, OR 97301-1280.
Objections to the release of funds on bases other than those stated
above will not be considered by OBDD. Potential objectors should
contact OBDD to verify the actual last day of the objection period. It
is estimated that any objection received after June 26, 2019 will not
be considered by OBDD
