Notice of Public Hearing
Notice is hereby given that the John Day Planning Commission is
considering the following land use application(s) under Chapter
5-4.2 Land Use Review and Site Design Review of the John Day
City Code.
McMillan – Sign Variance
Mrs. Virginia McMillan has applied for a Class B Variance for a sign
to be located at 13S31E26BB Tax Lot 1100 in John Day, OR (150
Ogilvie Drive). The applicant wishes to place a sign for her den-
tal practice on the northwestern corner of the property along Ford
Road. Mrs. McMillan is requesting a Class B Variance to build the
sign as a modification to the Conditional Use Permit for the business.
The property is zoned Residential General (RG).
Whitney McLellan / City of John Day – Sign Variance
Ms. Whitney McLellan has requested to place a “Home of the Pros-
pectors” sign at the east entrance of the city limits. The sign would
be placed within public right of way on the north side of U.S. High-
way 26, adjacent to the existing John Day population sign located
near 13S31E02702 Tax Lot 2702. The City of John Day is listed as a
co-sponsor for the application. Design options will be presented to
the John Day Planning Commission during the public hearing.
Sally Knowles – Site Design Review
Mrs. Sally Knowles is the owner of the property located at 13S31E-
23CA Tax Lot 2600 in John Day, OR (northern terminus of Canton
Street). The applicant wishes to build four duplexes (eight residential
dwelling units) on the property for use as rental units. A public hear-
ing is not required for this application; however, the applicant and
City Planning Official have referred the matter to the Planning Com-
mission due to the necessity to construct street improvements and
utility extensions to service the 1.2-acre development. The Planning
Commission’s review must focus on the relevant code criteria and
follow the public hearing procedures for a Type II (administrative)
review under Section 5-4.1.030. The Planning Commission should
approve the request, including the site plan, if it conforms to the ap-
proval criteria or if it can be made to conform to the criteria through
the imposition of reasonable conditions. The property is zoned Res-
idential Limited (RL).
A public hearing will take place on Tuesday, February 13 at 6:00
p.m. in the John Day Fire Hall, 316 S. Canyon Boulevard, John Day,
OR. Copy of the subject application(s), all documents, and evidence
relied upon by the applicant(s) and applicable criteria are available
for inspection at the John Day City Hall at no cost; copies will be pro-
vided upon request at a reasonable cost. Copies of the City Planning
Staff Report on the subject application will be available for inspec-
tion not less than seven (7) days prior to said hearing at no cost;
copies will be provided upon request at a reasonable cost.
Persons or parties interested in or concerned about the subject
application may appear in person at said hearing, or may submit
written testimony to City Hall on or before the date of the hear-
ing. Failure to raise an issue in person, or by letter at the hearing,
or failure to provide statements or evidence sufficient to afford the
decision-maker an opportunity to respond to the issue, means that
an appeal based on that issue cannot be filed with the City Council
and/or State Land Use Board of Appeals based on that issue.
Any questions regarding the hearing should be directed to the City
Manager at 450 E. Main, John Day or phone (541) 575-0028, Mon-
