Instead of a typically lower
sentence, Burch stipulated to an
upward departure with 40-month,
consecutive sentences for each
of the charges in the plea agree-
ments. Other counts from each of
those criminal cases would likely
be dismissed.
A third criminal case with sex
crime charges will be dismissed
when the other two cases are sen-
tenced, according to Sullivan’s
Dec. 14 minute order from the
settlement conference. In that
case, a grand jury indicted Burch
March 15 on charges of first-de-
gree sexual abuse and second-de-
gree sexual abuse to a single
victim younger than 14 between
December 2012 and December
2015.
Burch was first indicted Feb.
12, 2016, on charges of first-de-
gree sexual penetration, first-de-
gree sexual abuse, second-degree
sexual abuse, coercion, third-de-
gree sexual abuse, two counts of
menacing and interfering with
making a report for alleged inci-
dents with a single victim on Jan.
17 and Jan. 21, 2016.
He pleaded guilty to the sec-
ond-degree sexual abuse charge
in the plea agreement, a Class C
felony.
Burch was indicted March
8, 2016, on charges of first-de-
gree rape, first-degree sodomy,
first-degree sexual penetration,

National Weather Service had
forecast freezing rain and ice
accumulations for the Pendleton
and Pilot Rock areas, and Grant
County saw four motor vehicle
accidents on area highways.
There were no injuries in the
first, a single-vehicle rollover
crash on Highway 395 near Can-
yon City about 3:30 p.m. The
northbound pickup lost traction,
wandered onto the gravel shoul-
der and left the roadway. The
driver was from Canyon City.
Oregon State Police responded
to a single-vehicle crash on High-
way 26 near Mt. Vernon about
two hours later. The driver of the
Isuzu Rodeo was given a courtesy
ride to her home in John Day.
Less than an hour later, a
Prairie City woman was injured
when the GMC Suburban she
was riding in left Highway 26
near Austin Junction and rolled.
The roadway was covered with
snow at the time. The Prairie
City driver was not injured, but
the passenger was transport-
ed to the hospital with minor
injuries.
Around 8 p.m. on Dec. 15, a
GMC Safari left Highway 395
near the Logan Valley Road junc-
tion and rolled. The occupants of
the van were gone by the time
Oregon State Police arrived at the
scene.

Rapp to pay child support to his

Rapp has faced numer-
ous misdemeanor and felo-
ny charges since May 2007.
Many of the charges were
dismissed, but he was con-
victed of theft, disorderly
conduct, drug possession,
wildlife violations and vari-
ous traffic offenses, accord-
ing to court records. He was
also sentenced in 2015 to
18 months probation for not

In November 2009, Rapp
was charged with men-
acing, criminal mischief,
second-degree assault and
disorderly conduct follow-
ing an incident involving a
high-speed chase near Dixie
Summit. He pleaded guilty
to second-degree disorder-
ly conduct, and the other
charges were dismissed.
The incident began with
a confrontation between two
groups of men in two vehicles
in the North Fork Bridge Creek
area. A chase ensued, with the
vehicles leaving a dirt road and
turning onto Highway 26 head-
ing east.
The vehicles passed through
a construction zone at high
speeds, forcing a worker to leap
out of the way. Witnesses said
they saw one vehicle bump the
other. The chase ended at Aus-
tin House, where occupants in
the first vehicle were able to get
out and call police.
Rapp was arrested that day
but was later released to under-
go treatment for a fracture and
broken nose he suffered during
the initial confrontation. His
father, Gary R. Rapp, later
pleaded guilty to second-de-
gree attempted assault, reck-
less driving, recklessly endan-
gering a highway worker and
menacing. A third man in their
car, Cody B. Sederlin, plead-
ed guilty to second-degree
disorderly conduct, and two
charges of menacing were
dismissed.
