Notice of Scholarship Application
A Public Hearing will be held in Prairie City before the City
Council at City Hall, 133 Bridge Street, on September 13,
2017 at 6:00 p.m. to address a request from Loren E. Bebb
for a Type II Conditional Use Permit. Mr. Bebb is requesting
a conditional use to erect a 200’ cell tower on a portion
of his property located at Tenth Street and Hall Avenue
in Prairie City, Parcel No. 13S 33E 11BC, Tax Lot 500
(previously known as “Wishard Turkey Farm”). The cell tower
is to be erected and owned by U.S. Cellular. The proposed
site location lies within a designated residential R-2 zone.
A copy of the application and site diagram are available for
review at City Hall. The public is invited to attend the Public
Hearing at which testimony regarding the proposed use will
be received. Written testimony may be submitted to City
Hall, 133 Bridge Street, or mailed to P.O. Box 370 Prairie
City, Oregon 97869 up until 5:00 p.m. on September 13,
2017.
At the August 23, 2017 Grant County Court meeting, the
County Court approved and initiated the following projects
for funds received to the County from the Secure Rural
Schools and Community Self-Determination commonly
known as Title III. The funds were received in March 2016.
The amount for this initiation is: $85,531.91 as verified by
the Grant County Treasurer.
Project 1 is to support, assist and implement the Firewise
Communities program in communities in John Day and
Canyon City, the Laycock Creek area of the county, and the
City of Dayville. $40,531.91.
Project 2: Search and Rescue and other emergency services
is set at $10,000 based on historical data for such services
in the past.
Project 3 will be to update the County’s Community Wild
Fire Protection Plan in coordination with the US Forest
Service staff of Umatilla, Wallowa/Whitman, Ochoco, and
Malheur Forests. $35,000.00
A 45-day comment period is opened from the date of this
publication. Individuals wishing to comment on the initiated

Gertrude L. Mc Rae Trust Fund scholarship applications
are now available for 2017-2018. Applicants must be a
Grant County high school graduate to qualify. Graduates of
high schools in Morrow, Wasco and Wheeler counties may
also be considered, if too few Grant County applications
are received. Preference will be given to Grant County
graduates who reside in Oregon and have already
completed one or more years at an accredited college. To

Reference is made to that certain trust deed made by
Machelle K. Leggett, as grantor, to Land Title Company
of Grant County, Inc., as trustee, in favor of Stanley G.
Hickman and Nanette Hickman, Co-Trustees of the S &N
Hickman Trust dated September 17, 2010, as beneficiary,
dated June 17, 2016, recorded June 21, 2016, in the
Mortgage records of Grant County, Oregon, as Instrument
No. 20161265, covering the following described real
property situated in said county and state, to-wit:

this reference made a part hereof
Both the beneficiary and the trustee have elected to sell
the said real property to satisfy the obligations secured by
said trust deed and a notice of default has been recorded
pursuant to Oregon Revised Statutes 86.735(3); the default
for which the foreclosure is made is grantor’s failure to pay
when due the following sums:
Five monthly installments of $222.74 each;
2016-2017 real property taxes of $434.90 plus interest; plus
any additional amounts owing pursuant to the Promissory
Note secured by the Trust Deed or pursuant to the Trust
Deed and any further advances made by the beneficiary as
allowed by the Promissory Note and Trust Deed.
By reason of said default the beneficiary has declared
all sums owing on the obligations secured by said trust
deed immediately due and payable, said sums being the
following, to-wit:
The principal sum of $20,957.24 with interest
thereon at 4% per annum from February 10, 2017, until paid;
cost of foreclosure report; attorney’s fees, trustee’s fees,
together with any other sums due or that may become due
under the Promissory Note secured by the Trust Deed or
by any reason of this foreclosure and any further advances
make by Beneficiary as allowed by the Note and Trust Deed.
WHEREFORE, notice hereby is given that the undersigned
trustee will on October 17, 2017, at the hour of 10:30 a.m.,
in accord with the standard of time established by ORS
187.110, the front (east) entrance of the Grant County
Courthouse, 201 S. Humboldt Street in the City of Canyon
City, County of Grant, State of Oregon, sell at public
auction to the highest bidder for cash the interest in the
said described real property which the grantor had or had
power to convey at the time of the execution by grantor of
the said trust deed, together with any interest which the
grantor or grantor’s successors in interest acquired after
the execution of said trust deed, to satisfy the foregoing
obligations thereby secured and the costs and expenses of
sale, including a reasonable charge by the trustee. Notice is
further given that any person named in ORS 86.753 has the
right, at any time prior to five days before the date last set
for the sale, to have this foreclosure proceeding dismissed
and the trust deed reinstated by payment to the beneficiary
of the entire amount then due (other than such portion of the
principal as would not then be due had no default occurred)
and by curing any other default complained of herein that
is capable of being cured by tendering the performance
required under the obligation or trust deed, and in addition
to paying said sums or tendering the performance necessary
to cure the default, by paying all costs and expenses
actually incurred in enforcing the obligation and trust deed,
together with trustee’s and attorney’s fees not exceeding the
amounts provided by said ORS 86.753.
Without limiting the Trustee’s disclaimer of representations
or warranties, Oregon law requires the Trustee to state in this
Notice that some residential property sold at a Trustee’s sale
may have been used in manufacturing methamphetamines,
the chemical components of which are known to be toxic.
Prospective purchasers of residential property should be
aware of this potential danger before deciding to place a bid
for this property at the Trustee’s sale.
In construing this notice, the singular includes the plural,
the word “grantor” includes any successor in interest to the
grantor as well as any other person owing an obligation, the
performance of which is secured by said trust deed, and
the words “trustee” and beneficiary” include their respective
successors in interest, if any.

INVITATION TO BID
HOLMES MIDDLE FORK
JOHN DAY RIVER FENCE PROJECT
Individually sealed bids will be received from qualified
vendors by Grant Soil and Water Conservation District
(hereinafter called DISTRICT), at 721 South Canyon
Boulevard, John Day, Oregon 97845 until 3:00 PM PST,
September 12, 2017 for the construction of approximately
0.9 miles of wire fence along the Middle Fork John Day
River in Grant County, Oregon. Immediately thereafter, Bids
will be publicly opened. The full Invitation To Bid package,
including all Addenda may be obtained through the project
point of contact, Jason Kehrberg at 541-575-0135 ext. 110
or e-mail jkehrberg@ortelco.net, by visiting the DISTRICT
Office at above address, or at the DISTRICT’S website www.
grantswcd.net.
The Project location is approximately 16 miles west of the
community of Bates, Oregon. All work associated with
this Invitation To Bid must be completed within a 30 day
performance period. Liquidated damages of $100 per day
will apply to the contract resulting from this Invitation To Bid,
upon the contractor’s failure to complete the work within the
specified time.
This Invitation to Bid and the resulting Contract are
subject to the provisions of the Federal Davis-Bacon Act
(40 U.S.C. 3141 et seq.) and Oregon Revised Statutes
279C.800 through 279C.870 relative to Oregon Prevailing
Wage Rate Law.
A voluntary pre-bid conference and tour of the work area

bid conference and tour, but with the complexity of this
project it is strongly recommended that bidders or their

**SPECIAL NOTE**
ALL FENCING ASSOCIATED WITH THIS PROJECT WILL
BE CONSTRUCTED WITH STEEL FENCE STRUCTURES,
REQUIRING THE CONTRACTOR TO PERFORM FIELD
STEEL FABRICATION AND WELDING SERVICES.
Project will require the use of a mechanized post
pounder, Shaver Manufacturing Company LLC Model
HD-8 or DISTRICT approved equivalent, capable of
driving a 6 inch pointed wood post to a depth of 3 feet in
undisturbed rough terrain.
Individually sealed envelopes or packages containing bids
and supporting data as stipulated in the instructions to
Bidders shall be clearly marked with the vendor’s name and

DAY RIVER FENCE PROJECT. Bids sent by mail should
be forwarded by certified mail, return receipt requested,
addressed to the DISTRICT as shown above, in care of Pat
Holliday, and likewise shall be clearly marked or endorsed as
stated herein.
Bids received after the time established for receipt of bids
will not be considered. Bids may be withdrawn or modified
in writing at any time prior to bid opening, following the
guidelines established in the Invitation to Bid.
The DISTRICT may reject any Bid not in compliance with all
prescribed public bidding procedures and requirements and
reserves the right to reject for good cause any or all Bids
in whole or in part upon the finding of the DISTRICT that it
is in the public interest to do so, to waive irregularities not
affecting substantial rights, and to postpone the award of
the work as necessary for a period of time not to extend
beyond thirty (30) days from the Bid Opening Date. Bid
prices quoted shall remain firm for a period of thirty (30)
days from the date of Bid Opening.
The apparent successful Bidder shall provide all required
proofs of insurance, furnish all applicable security bonds,
and other specified deliverables to the DISTRICT within
twelve (12) calendar days from date the Intent-to-Award
Announcement is issued by the DISTRICT. Failure to
present the required documents within this period may result
in Bid rejection.
