Magone Project
Notice of 45-day Objection Filing Period
The Blue Mountain Ranger District of the Malheur National
Forest has prepared a draft record of decision (draft ROD)
and a final environmental impact statement (FEIS) for the
Magone Project. These documents are available on the Mal-
heur National Forest website at: http://www.fs.usda.gov/pro-
ject/?project=44907. Copies of the FEIS and draft ROD are
available at the Malheur National Forest Supervisor’s Office/
Blue Mountain Ranger District, 431 Patterson Bridge Road,
John Day, OR 97845. Additional information can be obtained

The draft ROD includes approximately 14,147 acres of
silviculture and activity fuels treatments, 28,500 acres of pre-
scribed burning, 12.5 miles of temporary road construction,
use of 98.5 miles of existing Forest Service system road
for log haul (including road maintenance), 0.3 miles of road
decommissioning, 1.1 miles of road closures (changing from
maintenance level 2 to 1), confirmation of 8.34 miles of past
administratively closed roads, 26.3 miles of new trail (17.2
miles of new trail construction and 9.1 miles of trails co-des-
ignated on existing roads), improvement of three existing
trailheads and construction of one new trailhead, interpretive
sign placement at four sites, improvement of the existing
day use boat dock and replacement of existing campground
boat mooring, and placement of fish cribs and fish sticks in
Magone Lake. This project also includes forest plan amend-
ments to reduce cover below Malheur Forest Plan standards
in Big Game Winter Range (Management Area [MA] 4A),
summer range, and the Nipple Butte Wildlife Emphasis Area
(MA21), and to change old growth boundaries and designate
new old growth areas to bring these areas up to Malheur
Forest Plan standards. The Magone planning area is located
on the Blue Mountain Ranger District, approximately 7 miles
north of John Day, OR.
The draft ROD is subject to an objection process pursuant
to Forest Service regulations at 36 Code of Federal Regu-
lations (CFR) 218. The regulations at 36 CFR 218 provide
an opportunity for individuals and organizations to file an
objection to a project before the final decision is signed. This
allows interested individuals and organizations to share their
concerns regarding the decision with the deciding official
before the final decision is made.
Objections will only be accepted from individuals and
entities as defined in 36 CFR 218.2 who have previously
submitted specific written comments regarding the pro-
posed project during the 30-day scoping period or 45-day
comment period on the draft environmental impact state-
ment in accordance with 36 CFR 218.5(a). Issues raised in
objections must be based upon previously submitted timely,
specific written comments regarding the proposed project,
unless based on new information arising after the designat-
ed comment opportunities.
Objections, including attachments, must be filed via mail,
fax, email, hand-delivery, express delivery, or messenger
service (Monday through Friday, 8:00am to 4:30pm, exclud-
ing Federal holidays). Objections may be mailed to: Regional
Forester, Objection Reviewing Officer, Pacific Northwest Re-
gion, USDA Forest Service, Attn: 1570 Objections, PO Box
3623, Portland, OR 97208-3623. For emailed objections,
email: objections-pnw-regional-office@fs.fed.us. Please
put OBJECTION and the project name in the subject line.
Electronic objections must be submitted as part of an actual
e-mail message, or as an attachment in Microsoft Word for-
mat (.doc), rich text format (.rtf) or portable document format
(.pdf) only.
For electronically mailed objections, the sender should
normally receive an automated electronic acknowledgement
from the agency as confirmation of receipt. If the sender
does not receive an automated acknowledgement of receipt
of the objection, it is the sender’s responsibility to ensure
timely receipt by other means. Objections may also be
hand-delivered to the Pacific Northwest Regional Office,
1220 SW 3rd Ave., Portland, OR 97204, between 8:00am
and 4:30pm, Monday through Friday (excluding Federal hol-
idays). Objections may also be faxed to: Regional Forester,
Attn: 1570: Objections, at 503-808-2339.
Objections must be postmarked or received by the Re-
viewing Officer, Regional Forester, within 45 days following
publication of notice of the objection filing period in the Blue
Mountain Eagle, John Day, OR. The publication date in the
Blue Mountain Eagle is the exclusive means for calculat-
ing the time to file an objection. Those wishing to file and
objection should not rely upon dates or timeframe informa-
tion provided by any other sources. The regulations prohibit
extending the time to file an objection.

Specific directions on how to file an objection are provided
in 36 CFR 218.8. (A printed copy is available upon request).
The objection must contain the minimum required content
requirements specified in 36 CFR 218.8(d) and incorporation
of documents by reference is permitted only as provided in
36 CFR 218.8(b). It is the objector’s responsibility to ensure
timely filing of a written objection with the reviewing officer
pursuant to 36 CFR 218.9. All objections are available for
public inspection during and after the objection process.
Objections will be subject to review by a “reviewing officer.”
Because the responsible official for the Magone Project is
Steve Beverlin, the Malheur National Forest Supervisor, the
reviewing officer will be the Regional Forester.
The objection process may include an opportunity for the
objector to meet with the reviewing officer and responsible
official, with the objective of resolving the concerns ex-
pressed in the objection.
The responsible official cannot sign the final decision until
the reviewing officer has responded in writing to all pending
objections, and the decision must be consistent with any in-
structions issued by the reviewing officer. After the objection
process concludes, there will be no additional opportunity
for administrative review or appeal. The final decision will be
the final administrative decision by the agency.
