Grant County Fairgrounds
on the walking trail along
the river, John Day Police
Chief Richard Gray said.
The fire was contained to
the log.
Gray said he discovered
a burnt cigarette butt that is
believed to have started the
fire.
“It’s still very high fire
danger,” he said. “Make
sure that burning embers are
dead out.”

Circuit Court
CANYON CITY — The
Grant County Circuit Court re-
ported the following ines and
judgments:
• Sheryl Grifith was con-
victed of theft in the irst degree
on Sept. 3. Grifith is sentenced
to 2 years of probation with 200
hours of community service and
is required to pay a $5,000 ine
to the victim and $500 in court
fees as well as having no contact
with the victim and no entry into
Blue Mountain Mini Mart.
• Russell Leroy Williams
was convicted of violating pro-
bation on Sept. 1. Williams
admitted to violating terms of
probation and was sentenced to
complete treatment by Feb. 1.

• John Day Police:
Aug. 27: Assisted with
emergency rations due to a wa-
ter problem in a residence on
West Main Street.
Aug. 30: Arrested a
26-year-old man for menac-
ing and disorderly conduct
after responding to a report
of a subject who was possibly
wielding a knife.
Sept. 4: Received a call of a
“goat at large.”
Received a report of a run-
away.
• Grant County Sheriff:
Aug. 26: responded to a bur-
glary on Middle Fork Lane.
Aug. 29: Responded to a re-
port of a fatal accident on High-
way 395 near Ritter Junction.
Sept. 1: Responded to a
report of shots being ired on
Harper Creek Road; arrested a
woman for possession of meth-
amphetamine.
Sept. 3: Portland Police ar-
rested a 44-year-old Hillsboro
woman on a Grant County
warrant; Jefferson County dep-
uties arrested a 53-year-old Mt.
Vernon man on a Grant County
warrant.
• John Day ambulance:
Aug. 27: Responded to a
rollover accident on Highway
26 near the ish farm.
Sept. 2: Ambulance dis-
patched for a report of a female
subject suffering either an over-
dose or a stroke in the Mead-
owbrook Apartments.

Police recovered a pickup
Tuesday, Aug. 30, that was
stolen in John Day.
The owner of the white
GMC pickup stolen from the
100 block of Second Avenue
reported the vehicle stolen
at 1 a.m. Aug. 30 when she
returned home after being
out of town, John Day Police
Chief Richard Gray said.
Later that morning, po-
lice received a tip the vehicle
was in Prairie City, he said,
but it was on the move be-
fore oficers arrived.
Oregon State Police
Trooper Cody Weaver locat-
ed the vehicle and initiated a
trafic stop at milepost 1 on
County Road 62, Gray said.
John Day police also re-
sponded, Gray said, and the
two occupants of the vehicle
were detained.
The driver of the vehicle,
David Wesly Burke, was lat-
er arrested and charged with
unauthorized use of a vehi-
cle, possession of metham-
phetamine and irst-degree
criminal mischief. He is set
to appear in court at 1 p.m.
Sept. 7.
The passenger of the ve-
hicle, a 26-year-old John
Day man, was released.
Gray said tips from the
public led to the recovery of
the vehicle.
“I would really like to
thank the public for being
involved and giving us in-
formation,” he said.
Rail Fire nears containment
Blue Mountain Eagle
The Rail Fire is 41,716
acres and is 85 percent con-
tained, according to a press
release from the manage-
ment team.
Mop-up and repair as-
signments are nearing com-
pletion as firefighters are
being demobilized for rest
and reassignment to other
fires. Crews are using heavy
equipment to repair roads
and fire lines as well as
building water bars and re-
working side-slopes to pre-
vent erosion.
Rain Tuesday was expect-
ed to help containment lines
hold. Areas around the fire
remain closed as do parts of
Forest Road 16 and Forest
Road 2652.
The fire is currently
staffed by 624 people: 18
crews, 13 engines, one doz-
er, 16 water tenders, one
masticator and four helicop-
ters.
Malheur National Forest
officials reduced the Indus-
trial Fire Precaution Level to
Level III on Tuesday and re-
duced the fire danger rating
to High.
Campfires are still not al-
lowed; only liquid and bottle
gas stoves and heaters are
permitted. Chainsaw use is
prohibited. No internal com-
bustion engine operation is
permitted, with the excep-
tion of motor vehicles.
Electrical generators are
allowed only if the generator
is placed in an area 10 feet
in diameter that is cleared of
flammable material, or is ful-
ly contained within a pickup
truck bed. Recreational ve-
hicles with generators must
have the exhaust discharge
centered in a 10-foot area
that is cleared of flammable
material.
Off-road/off-trail
ve-
hicle travel on roads not
cleared of standing grass
or other flammable mate-
rial is not allowed. Vehicle
travel on Forest Service
roads that are closed is not
allowed.
Smoking is only allowed
within vehicles, buildings
and developed recreation
sites or when stopped in an
area cleared of all flammable
material.
