An editorial comment in a re cent issue of the Omaha Workl- Herald, regarding New Jersey justice: New Jersey maybe depended upon at al! times to come to the rescue when something that adds to the humor of the day is needed. The latest exhibition of purely Jerseyesque humor is afforded by the supreme court of that state, A child was killed by a railroad train and the father brought suit for damages. The lower court found for the father, fixing the damages at $6,ooo. The railroad company took an appeal to the the supreme court, and the grave and dignified justices reversed the findings of the lower court. The supreme court found that '.the damages were excessive because “children as a rule are expensive and not a pecuniary benefit to their parents.” In other words the father should have sent his thanks to the railroad company for having killed his child, the killing having removed a pecuni ary burden from his shoulders. Had the child lived it would have cost the father a great deal of money for food clothing, medicine schooling, etc., but by having it killed he was saved this expendi ture. This is peculiar logic, but it is New Jerseyesque in the ex treme. It makes the life of the children purely a matter of dollars and cents, the burden falling upon the parents. We opine, after reading the supreme court’s decis ion in this case, that that court would find a verdict for the rail road company in case it sued the bereaved father for a few thous and dollars for-‘servic< s rendered.” Under the supreme court’s decis ion the railroad company certainly performed a favor for that father.
