Preferred Vested Water Rights, to tho amount of l.S acre feet as per tho terms of tho adjudication. RULE 2. The Uoard agrees to furnish and deliver tho amount cf water stipulated at tho most practic able point to bo reached by gravity flow from Its main canal, ditches r laterals. Said point of delivery sha'l bo ascertained and determined by tho Project Enginoer or Project Manager and In case of a dispute between tho Project Engineer or Managor and tho tottlcrs as to the proper point of de liver', the question shall be submit ted to the State Engineer, whose do cWlon shall bo final. Tho po'nt or points of delivery may bo changed by tho Board after being so established. the necessary expenses, however, caused by such chongo shall be paid by tho Board. RULE 3. Tho Board reserves the right and option on Its part to deliver said water to any settler or settlers under tho rotation system by giving the settler ten days' notice In writing of its Intention to do so. RULE 4. All necessary ditches, gates or measuring devices to be In stalled by the settler after tho watir has passed tho point of dsllvory will, upon request, bo installed by tho Board, but tho cost will be charged to the settler and must be paid y him. RULE 0. Wator delivered to each settlor may be used for stock, domes tic and Irrigation purposes onl, aad only on the lands deecrlbod in each contract and for no other purposes whaUtoover The Hoard will furnish water periodically whon necessary and possible during such times out side the Irrigation season for stock and domestic purposes. The Boat 3 will not be held responsible for any shortage of water for stock and do mestic purposes during the non-irrigation season when it Is impossible or Impracticable to run wator through the ditches. RULE 7. The settler will bo ex pected to use all the water and allow none to run to waste and will provide proper drainage for nil waste watera entering his land. Wafer may be shut off from any settler who deliberately wastes bis water or does not put fame to beneficial use. itULE 8. The contract holder nr settler will not bo allowed to disturb, pollute or causo to become impute tbo water in any flume, canal or lat eral, or allow any act to bo dono which may cause to become so. The Board may whn necessary shut tba water off from Its canals, laterals or ditches for the pu. poso of repairing same and may havo such reasonable tlmo as may 'j necessary In which to mako such re pairs And for such interruption of -water supply the Board will not be liable to the settler. Until further notico is given the settler will be expected to pay an annual maintenance fee of 80 cents per acre, which shall be placid In tho Tumalo Maintenanco fund and to be used only for tbo operation and maintenanco of the Tumalo Project.
