The matter has been brought to an Issue by two resolutions prcsantod to tho board last weok It Stite Engin eer Lewis and a roport from john Dubuls. who was appointed by tho board to make an Investigation with epeciat reference to the list of lands recontly submitted by the company for certification and patent. The board postponed action on tho reso lutions until officers of the company could be given an opportunity to ap pear before tho board in defense. They havo been Invited to meet with the board for this purpose. In his resolution referring to the contemplated enlargement of the Central Oregon canal, Mr. Lewis says that "it is apparent that tho Central Oregon canal must be enlarged from tho end ot the present enlargement to the entrance ot the stave pipe. In order that It may properly serve the sold acreage below said stave pipe. ' He points out that as the contract with the United States for tho recla mation of the lands oxplres October 17, 1915, this enlargement cannot await possible financing ot tho North Canal project, and he requests the loard to order this enlargement be foro the irrigation season ot 1914. His second resolution Is an order to revoke and cancel all Approved lists of lands remaining unsold and to forbid further sales. Itcport of Dubuli. In his report to tho board. Inspec tor Dubuls finds that the oanal cap acity is not sufficient to supply water to the lands already sold, patonted or listed tor patent. For reclamation, one second foot of water must bo delivered for each 100 acres of irrigable land ns provided in set tlors' contracts. While n dotatlod re port on Boopagc losses has not ns yet been prepared, tho fundamental tacts show that tho average canal losses tor the system na n whole tor tho past two soasons arc nbout SO per cent of tho water diverted from tho stream. This would tenvo only 345 second feet available for delivery to tho land, or sufficient to irrlgato 34,500 acres. This is 174 acres less than tho Irrlgablo cren already patented or listed for patent. "It therefore appears that furthor lands cannot bo approved for patent until tho carrying capacity ot exist ing canals is increased. Under tho Central Oregon Canal tho maximum amount of water which can bo crowd ed through tho Intake structure is 313 second feet of water, which with 60 per cent Ions Is not sufficient to supply tho 17,450 acres heretofore patented or listed for patent. It Is undoistood that this deficiency will 1 remedied In tho near future whor. It Is apparent that this portion of tho cannl will carry a somewhat larger quantity of water. Out no additional amount of water can bo spared from the Pilot llutto Canal system until the North Cannl is put in such shnpo as to carry an increased quantity of water." Statement of State Knginecr. Accompanying Mr. Dubuls' roport was a statement from Stato Engineer Lewis. Ilesatd: "From n careful summary of nil avaliablo data relative to tho Central Oregon Irrigation Company's Project it uppears that 25,573 acres of Irri gable land havo been sold under the . Central Oregon Cnnal. In addition I to this, 7,477 acres ot irrigable land I are now open for entry and sale. The j total area of Irrigable land under this i canal Is 37,134 acres, of which 4.0S4 ' acres have not as yet been opened ' for entry and sale. ! "This canal recently enlarged will , not deliver the contract amount of water for the lands sold, and open for i sale, pn the hauls of 30 per cent seep age loss.
