tho Bond Lumber Company, compos
ed of A. H. Horn, V. F. McNought
and V. E. Scott, against J. II. Mon
tague, P. C. Campbell, Mlko Zupan,
D. E. Hunter Realty Company, Mlko
Mcdrath, A. C. Seeley and Daisy See-
ley. The Judge rendered his decis
ion In favor of the defendants.

$540.65 on lumber which was furn
ished by the plaintiffs for tho con
struction of the building now occu
pied by tho Club Care, on Hond
street. Tho contractor was Monta
gue, who suddenly left town owing
the lumber company. Tho other de
fendants were brought Into the caso

tho caso went later to the Circuit
Court for hearing. It was referred
to J. M. Lawrence aa referee and tes
timony was. taken here last summer.
Judge Bradshaw announced his de
cision In a letter to V. A. Forbes, tho
attorney for the defendants. The
plaintiffs were represented, upon the
trial of the caso by C. S. Benson; al
though, lien statement on which the
suit watbrought'waa prepared -by Mr.

George W .Wlraer and wife of
Tumalo havo tlcpnrted for their new
home at Ashland, having left Bend
last Thursday morning. Mrs. Wlraer
has been for some weeks In a critical
condition with rheumatism, and has
also been suffering from a broken
wrist which she sustained some time
ago from a fall. She hopes that the
change of climate at this time will
prove beneficial to her as well as to
Mr. Wlmer, who also Is not In the
best of health.
They expect to return during the
summer for a short time at least.
Mr. Wlmer Is very enthusiastic
over the prospects of the Jiend coun
try and says were he a young man
again he would not think of leaving
but that on account of old age he Is
going to a lower altitude to see if it
will improve his health.

pipe. This was followed by bullets.

Receipts for tho week have been:
Qattle 1106, calvos CO, hogs 4415,
sheep 36C2, horses 46. Beef liqui
dation has been liberal thla week,
Just a trifle too heavy for trade need.
Steer offerings were mostly half fat
stuff which buyers took over at
$7.25 to 97.S0. Top loads realized
$7.70 and cows and heifers sold well
in email lots, but the market Is any
thing but strong. A good bull trado
ruled, while choice veal calves sold
at $9 to $9:50. Cattle market show
ed a weak tendency and Is off a nlc
kel. Despite a five thousand run of
bogs, tho market supported n $9.15
price range all week, and an active
ecBBlon resulted. Trading was not
confined to light ewjne as smooth and
rough heavy varieties cut consider
able figure. Considering tho ehbr-
bjoub receipts, It is remarkable' tbaf
prices did not slump badly, but their
steadiness indicates the absorbing
ability of Coast pork buyers The
ebeep house bad a holiday this week,
fpr with the exception of Monday
